{"id":32059,"date":"2023-06-02T11:44:04","date_gmt":"2023-06-02T09:44:04","guid":{"rendered":"https:\/\/ccoo.app\/ics\/?p=32059"},"modified":"2023-06-02T12:13:32","modified_gmt":"2023-06-02T10:13:32","slug":"ccoo-us-informa-sobre-la-modificacio-de-la-llei-organica-de-salut-sexual-i-reproductiva-i-dinterrupcio-voluntaria-de-lembaras","status":"publish","type":"post","link":"https:\/\/ccoo.app\/ics\/noticies\/ccoo-us-informa-sobre-la-modificacio-de-la-llei-organica-de-salut-sexual-i-reproductiva-i-dinterrupcio-voluntaria-de-lembaras\/","title":{"rendered":"CCOO us informa sobre les noves situacions d\u2019incapacitat temporal"},"content":{"rendered":"\n<h6 class=\"wp-block-heading\"><strong>Amb la modificaci\u00f3 de la Llei org\u00e0nica de salut sexual i reproductiva i d&#8217;interrupci\u00f3 volunt\u00e0ria de l&#8217;embar\u00e0s, <strong>Llei org\u00e0nica 2\/2010, de 3 de mar\u00e7<\/strong><\/strong>,<strong> CCOO us resumeix la  informaci\u00f3 sobre l&#8217;ENTRADA EN VIGOR NOVES BAIXES a partir del 1 de juny de la Llei org\u00e0nica 1\/2023, de 28 de febrer, per la qual es modifica la, en la seva Disposici\u00f3 final tercera estableix la modificaci\u00f3 del text ref\u00f3s de la Llei General de la Seguretat Social, aprovat pel Reial decret legislatiu 8\/2015, de 30 d&#8217;octubre.<\/strong><\/h6>\n\n\n\n<p>Es creen tres nous sup\u00f2sits espec\u00edfics d&#8217;Incapacitat Temporal (IT) que entren en vigor a partir de l&#8217;1 de juny :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>IT per menstruaci\u00f3 incapacitant secund\u00e0ria<\/li>\n\n\n\n<li>IT per interrupci\u00f3 de l&#8217;embar\u00e0s<\/li>\n\n\n\n<li>IT per gestaci\u00f3 de la dona treballadora des del dia primer de la setmana 39<\/li>\n<\/ul>\n\n\n\n<p><strong>BAIXA PER REGLES INCAPACITANTS<\/strong><br>La baixa especial per menstruaci\u00f3 incapacitant secund\u00e0ria es configura com una situaci\u00f3 especial d&#8217;incapacitat temporal. <\/p>\n\n\n\n<p><em>Per\u00f2 qu\u00e8 s&#8217;ent\u00e9n per menstruaci\u00f3 incapacitant secund\u00e0ria?<\/em><br>L&#8217;art. 2.6 de la Llei abans esmentada el defineix expressament com a \u201csituaci\u00f3 d&#8217;incapacitat derivada d&#8217;una dismenorrea generada per una patologia pr\u00e8viament diagnosticada\u201d.<br>En aquest sentit, tindr\u00e0 aquesta consideraci\u00f3 aquella baixa laboral en qu\u00e8 pugui trobar-se la dona en cas de menstruaci\u00f3 incapacitant secund\u00e0ria o dismenorrea secund\u00e0ria associada a patologies com ara endometriosis, miomas, malaltia inflamat\u00f2ria pelviana, adenomiosis, p\u00f2lips endometrials, ovaris poliqu\u00edstics, o dificultat en la sortida de sang menstrual de qualsevol tipus, podent implicar s\u00edmptomes com dispareunia, disuria, infertilitat, o sagnats m\u00e9s abundants del normal, entre altres.<br>El subsidi s&#8217;abonar\u00e0 a c\u00e0rrec de la Seguretat Social (SS) des del dia de la baixa en el treball.<\/p>\n\n\n\n<p><strong>BAIXA PER AVORTAMENT (INTERRUPCI\u00d3 DE L&#8217;EMBAR\u00c0S)<\/strong><br>Es crea una IT especial per conting\u00e8ncia comuna, en cas d&#8217;interrupci\u00f3 de l&#8217;embar\u00e0s, sigui volunt\u00e0ria o no.<br>El subsidi s&#8217;abonar\u00e0 a c\u00e0rrec de la SS des de l&#8217;endem\u00e0 de la baixa en el treball, tenint l&#8217;empresa el deure d&#8217;abonar el salari \u00edntegre corresponent al dia de la baixa.<br>Aquesta IT cobrir\u00e0 a la persona afectada, mentre rebi assist\u00e8ncia sanit\u00e0ria pel Servei P\u00fablic de Salut i estigui impedida per al treball, sense perjudici d&#8217;aquells sup\u00f2sits en qu\u00e8 la interrupci\u00f3 de l&#8217;embar\u00e0s sigui deguda a accident de treball o malaltia professional, i en aquest cas tindr\u00e0 la consideraci\u00f3 de situaci\u00f3 d&#8217;incapacitat temporal per conting\u00e8ncies professionals\u201d.<\/p>\n\n\n\n<p><strong>BAIXA EN LA SETMANA 39 D&#8217;EMBAR\u00c0S<\/strong><br>Situaci\u00f3 especial de IT per conting\u00e8ncies comunes des del dia primer de la setmana 39 d&#8217;embar\u00e0s, es considerar\u00e0 tamb\u00e9 situaci\u00f3 especial d&#8217;incapacitat temporal per conting\u00e8ncies comunes la de gestaci\u00f3 de la dona treballadora des del dia primer de la setmana trentena novena\u201d<br>El subsidi s&#8217;abonar\u00e0 a c\u00e0rrec de la Seguretat Social des de l&#8217;endem\u00e0 de la baixa en el treball. L&#8217;empresa abonar\u00e0 el salari \u00edntegre corresponent al dia de la baixa.<\/p>\n\n\n\n<p><strong>S&#8217;EXIGEIX PER\u00cdODE M\u00cdNIM DE COTITZACI\u00d3?<\/strong><br>En el cas de la IT per baixa incapacitant i de la IT per interrupci\u00f3 de l&#8217;embar\u00e0s, no s&#8217;exigeix per\u00edode m\u00ednim de cotitzaci\u00f3. No obstant aix\u00f2, en el cas de la IT durant la setmana 39 d&#8217;embar\u00e0s, s\u00ed que s&#8217;exigeix per\u00edode m\u00ednim de cotitzaci\u00f3.<br>Les noves situacions especials de IT tenen la consideraci\u00f3 de IT per conting\u00e8ncies comunes.
