center\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 24px\">QU\u00c8 HA PASSAT A LA MESA GENERAL DE NEGOCIACI\u00d3 DE MAT\u00c8RIES COMUNES?<\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: arial, helvetica, sans-serif;font-size: 14px;color: #000000\">-26 de maig de 2020-<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El 31 d\u2019octubre de 2019, la Diputaci\u00f3 va convocar a una reuni\u00f3 a tots els sindicats per obrir el proc\u00e9s per a la constituci\u00f3 de la Mesa General de Negociaci\u00f3.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;background-color: #ffff00;font-size: 20px\"><strong>RESULTAT D\u2019AQUEST PROC\u00c9S<\/strong>:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">L\u2019article 34 del TREBEP tracta de la <strong>MESA GENERAL DE NEGOCIACI\u00d3 DEL PERSONAL FUNCIONARI (MGMf)<\/strong>, on <strong>CCOO, UGT, I-CSC <\/strong>i <strong>CGT<\/strong> estan legitimats per formar-hi part ja que compleixen amb el requisit d\u2019haver obtingut, a les eleccions sindicals, com a m\u00ednim el 10% de representativitat d\u2019aquest personal.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>El 8 de novembre de 2019 va quedar constitu\u00efda amb la pres\u00e8ncia dels 4 sindicats. <\/strong><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;font-size: 16px\">L\u2019article 36.3 del TREBEP tracta de la <strong>MESA GENERAL DE NEGOCIACI\u00d3 DE MAT\u00c8RIES COMUNES (MGNmc)<\/strong> (inclou personal funcionari i laboral) on <strong>CCOO <\/strong>i<strong> UGT<\/strong> estan legitimats per formar-hi part:<\/span>\n<ul style=\"text-align: justify\">\n<li style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;font-size: 16px\">\u00c9s condici\u00f3 per ser membre d\u2019aquesta taula tenir representaci\u00f3 al col\u00b7lectiu de funcionaris i laborals i assolir com a m\u00ednim un 10% de representativitat a cadascun d\u2019ells: <strong>nom\u00e9s CCOO compleix amb aquest requisit.<\/strong><\/span><\/li>\n<li style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;font-size: 16px\">No obstant, com a excepci\u00f3, tamb\u00e9 els sindicats que formin part de la Mesa General de les Administracions P\u00fabliques (CCOO, UGT i CSIF) poden participar a les <em style=\"color: #000000\">Meses General de Negociaci\u00f3 de mat\u00e8ries comunes de les Entitats Locals<\/em><span style=\"color: #000000\"> encara que nom\u00e9s hagin obtingut representaci\u00f3 en un dels dos col\u00b7lectius. <\/span><strong style=\"color: #000000\">En el cas de la Diputaci\u00f3 ho compleix el sindicat UGT.<\/strong><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>El 3 de mar\u00e7 de 2020 va quedar constitu\u00efda amb la pres\u00e8ncia de CCOO (8 membres) i UGT (7 membres).<\/strong><\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;background-color: #ffff00;font-size: 20px\"><strong>MESA GENERAL DE NEGOCIACI\u00d3 PERSONAL FUNCIONARI (MGNf)<\/strong> <\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;background-color: #ffff00;font-size: 20px\"><strong>REUNIONS DEL 31 D\u2019OCTUBRE, 4 i 8 DE NOVEMBRE DE 2019<\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La corporaci\u00f3 va iniciar el proc\u00e9s, recordant (mitjan\u00e7ant un informe escrit) a tots els sindicats que el\u00a0 TREBEP estableix l\u2019obligaci\u00f3 legal de constituir:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Una Mesa General de Negociaci\u00f3 de funcionaris (4 sindicats).<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Una Mesa General de Negociaci\u00f3 mat\u00e8ries comunes (on nom\u00e9s estarien legitimitats CCOO i UGT).<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">CCOO, tot i tenir coneixement del que marca la normativa i la jurisprud\u00e8ncia, va fer una proposta \u201c<em>ad hoc\u201d<\/em> amb l&#8217;objectiu d\u2019intentar constituir una \u00fanica mesa amb els 4 sindicats establint la composici\u00f3 d\u2019acord amb el que marca l\u2019article 6.2a de la Llei Org\u00e0nica de Llibertat Sindical.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">M\u00e9s enll\u00e0 del que desitj\u00e0vem, la resoluci\u00f3 final havia de garantir l\u2019efic\u00e0cia legal dels acords amb la m\u00e0xima seguretat jur\u00eddica.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Despr\u00e9s de diverses reunions i els posicionaments divergents existents, la corporaci\u00f3, el 8 de novembre de 2019, va decidir constituir la MGNf.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">CCOO vam comen\u00e7ar immediatament a treballar a la MGNf per\u00f2 recordant en tot moment que sense MGNmc ens trob\u00e0vem davant una greu inseguretat jur\u00eddica.<\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;background-color: #ffff00;font-size: 20px\">MESA GENERAL DE MAT\u00c8RIES COMUNES (MGNmc) <\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;background-color: #ffff00;font-size: 20px\">REUNI\u00d3 DEL 3 DE MAR\u00c7 DE 2020<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La corporaci\u00f3, el mateix dia que es va constituir la MGNf (8 de novembre de 2019), va convocar CCOO i UGT a una sessi\u00f3 per a constituir la MGNmc. <u>Cap dels dos sindicats citats vam assistir-hi (acta 224).<\/u><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Pel que fa a C<strong>COO, vam creure que era preferible donar-nos un temps<\/strong> per <strong>analitzar de nou la situaci\u00f3 jur\u00eddica<\/strong> resultant i postergar la decisi\u00f3 a m\u00e9s endavant.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Ens preocupava sobretot, quines conseq\u00fc\u00e8ncies, des d\u2019un punt de vista jur\u00eddic, podia tenir la no constituci\u00f3 d\u2019una MGNmc. La q\u00fcesti\u00f3, no era quants i quantes companyes laborals hi ha, sin\u00f3 la <strong>validesa i seguretat jur\u00eddica<\/strong> d\u2019all\u00f2 negociat en una \u00fanica seu sobre mat\u00e8ries que afectaven no nom\u00e9s a personal funcionari sin\u00f3 tamb\u00e9 al laboral.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La secci\u00f3 sindical de CCOO-Diba vam encarregar un <strong>informe al nostre Gabinet T\u00e8cnic Jur\u00eddic.<\/strong> Aquestes van ser les conclusions:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">De conformitat amb l\u2019art. 36.3 de l\u2019EBEP, per a la negociaci\u00f3 de totes aquelles mat\u00e8ries i condicions de treball comunes al personal funcionari, estatutari i laboral de cada Administraci\u00f3 P\u00fablica, <strong>\u00e9s ineludible la constituci\u00f3 de la MGNmc.<\/strong><\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Tal com determina la Jurisprud\u00e8ncia del Tribunal Suprem a la Sent\u00e8ncia 51\/2018, de 18 de gener, de la Sala C.A.: <strong>per poder formar part de la Mesa General de Negociaci\u00f3 de Mat\u00e8ries Comunes, cal haver obtingut, al menys, un 10% en cadascun dels \u00e0mbits: funcionarial i laboral<\/strong> (cliqueu <a href=\"https:\/\/supremo.vlex.es\/vid\/702169501\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff\">aqu\u00ed <\/span><\/a>per accedir a la sent\u00e8ncia).<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per tant, m\u00e9s enll\u00e0 de les intencions inicials de la secci\u00f3 sindical, quedava clar que <strong>no pod\u00edem seguir sense MGNmc<\/strong> i a m\u00e9s, d\u2019acord amb la Sent\u00e8ncia del TS del 2018, a la MGNmc nom\u00e9s podien estar presents CCOO i UGT.<\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;font-size: 20px;background-color: #ffff00\">QU\u00c8 VA PASSAR EN ALTRES OCASIONS?<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Excloure un sindicat <\/strong>per no complir amb el m\u00ednim del 10% de representativitat <strong>no \u00e9s una cosa nova<\/strong>. <strong>CCOO i CGT ho vam exigir al 2015 en el cas de CTeC<\/strong> (sindicat que existia abans a la Diputaci\u00f3) i que, tot i tenir pres\u00e8ncia a la Junta de Personal, no van tenir representaci\u00f3 durant el mandat 2015-2019 a la MGNmc. Llavors va quedar clar que s\u2019havia d\u2019excloure CTeC per a dotar de seguretat jur\u00eddica els acords (consta en les actes)<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Ara, amb la jurisprud\u00e8ncia a la m\u00e0, queda clar que l\u2019exig\u00e8ncia per a estar a la MGNmc \u00e9s haver obtingut el 10% en els <u>dos<\/u> \u00e0mbits: funcionarial i laboral.<\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;background-color: #ffff00;font-size: 20px\">SEGUIR TREBALLANT PER\u00d2 AMB SEGURETAT JUR\u00cdDICA<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Tenim la plena convicci\u00f3 que hi han molts altres espais de col\u00b7laboraci\u00f3 on \u00e9s pot treballar per a millorar les condicions de treball.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El nou <em>protocol per l\u2019establiment de criteris i mesures organitzatives, de prevenci\u00f3 i de protecci\u00f3 per a la represa de les activitats de la Diputaci\u00f3 de Barcelona <\/em>n\u2019\u00e9s un clar exemple:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">CCOO i UGT, signa l\u2019acord on correspon, es a dir, a la Mesa de negociaci\u00f3 de MAT\u00c8RIES COMUNES per\u00f2 aquest s\u2019ha treballat en el s\u00ed d&#8217;una Comissi\u00f3 T\u00e8cnica integrada per TOTS els sindicats amb, a m\u00e9s, reunions setmanals del CSS que ha perm\u00e8s als 15 delegats i delegades de prevenci\u00f3 exercir el seu dret de consulta i participaci\u00f3.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fixeu-vos que a m\u00e9s, s\u2019est\u00e0 treballant per exemple d\u2019una manera semblant a la Comissi\u00f3 T\u00e8cnica dels PAMOs. Els 4 sindicats coincidim tamb\u00e9 a les reunions de pressupost, calendari, Patronat, Comit\u00e8 de Seguretat i Salut, Comissi\u00f3 de Seguiment del Protocol, XBM, etc. \u00c9s a dir, l&#8217;\u00fanic lloc on no poden estar CGT i ICS \u00e9s la MGNmc. I <strong>no \u00e9s degut a una estrat\u00e8gia o qualsevol mena de conspiraci\u00f3 \u00absecreta\u00bb, sin\u00f3 perqu\u00e8 en cas contrari, suposaria que tots els acords assolits serien NULS.<\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Ara b\u00e9, i per sobre de tot, <strong>fem una crida a la coher\u00e8ncia:<\/strong> aquells que ara es senten ofesos, no poden un dia apel\u00b7lar al compliment escrupol\u00f3s, per exemple de la normativa en mat\u00e8ria de vot per correu sota amena\u00e7a d\u2019impugnar les eleccions sindicals (CCOO va demanar simplificar el proc\u00e9s i que la Diputaci\u00f3 sufragu\u00e9s les despeses dels tr\u00e0mits\u00a0 del correu certificat del personal del territori), i ara demanar no fer cas a la jurisprud\u00e8ncia marcada pel Tribunal Suprem.\u00a0<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per aix\u00f2, <span style=\"text-decoration: underline\"><strong>CCOO seguirem treballant<\/strong><\/span> per arribar al m\u00e0xim nombre d\u2019<strong>acords possibles que millorin les condicions de treball del personal de la Diputaci\u00f3 i seguirem atenent als treballadors i treballadores<\/strong> que necessitin suport i assessorament sindical. <\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;background-color: #ffff00;font-size: 20px\">NO ES TRACTA D&#8217;UNA DISPUTA SINDICAL\u00a0<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Alguns pretenen convertir aquest tema (com tamb\u00e9 ho fan amb molts altres) en una disputa sindical. Res m\u00e9s lluny de la realitat. <\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>CCOO-Diba hem sotm\u00e8s totes les nostres decisions a criteris jur\u00eddics.<\/strong> Hem tingut en compte el posicionament dels serveis jur\u00eddics de la Diputaci\u00f3 per\u00f2 sobretot, hem actuat sempre ajustant les nostres decisions al criteri del nostre Gabinet juridic (cliqueu <strong><a href=\"https:\/\/www.ccoo.cat\/gabinet-juridic\/\"><span style=\"color: #0000ff\">aqu\u00ed<\/span><\/a><\/strong>)\u00a0<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Sabem que la dif\u00edcil decisi\u00f3 que hem pres pot ser objecte de demandes. Benvingudes siguin. \u00c9s del tot leg\u00edtim. En qualsevol cas, si com a conseq\u00fc\u00e8ncia d&#8217;aquestes hem de rectificar, ho farem, com no pot ser d&#8217;una altra manera! Ara b\u00e9, que tothom ho tingui clar, les decisions que s&#8217;hagin de prendre sempre estaran condicionades a all\u00f2 que el nostre Gabinet Jur\u00eddic ens indiqui. <\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per tant, no es tracta de si CCOO-Diba vol o no que estiguin la resta de sindicats a la Mesa de mat\u00e8ries comunes, sin\u00f3 la q\u00fcesti\u00f3 \u00e9s si poden estar.
