DEPEND\u00c8NCIA<\/span><\/p>\n<p style=\"text-align: center\"><strong><span style=\"color: #ff0000\">(modificaci\u00f3 del 29.04.2021 CLIQUEU <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/diba.ccoo.cat\/protocolanticovidvigentfinsa_juliol_2021\/\">AQU\u00cd<\/a><\/span>)<\/span><\/strong><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;background-color: #ffff00\">Es mant\u00e9 la vig\u00e8ncia de la mesura relacionada amb el tancament dels centres educatius, de cura de gent gran o de persones amb discapacitat i\/o depend\u00e8ncia fins el MES DE JULIOL DE 2021.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;background-color: #ffff00\">Es a dir, que davant un\u00a0<strong>tancament total o parcial<\/strong>\u00a0d\u2019un centre educatiu (o d\u2019una classe) que\u00a0<strong>impossibiliti portar l\u2019infant\u00a0<\/strong>(sigui alguns dies de la setmana o tots)\u00a0l\u2019empleat o empleada li ser\u00e0 concedit de nou el perm\u00eds regulat a l\u2019article 48 j) del\u00a0<em>TREBEP<\/em>\u00a0si per les caracter\u00edstiques del lloc de treball no pot passar a la modalitat de teletreball (de la mateixa manera s\u2019actuar\u00e0 si el tancament afecta a un centre de cura de la gent gran o de les persones amb discapacitat i\/o depend\u00e8ncia).<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2968 aligncenter\" D\u2019acord amb el <em>Protocol mitjan\u00e7ant el qual s\u2019estableixen criteris i mesures organitzatives, de prevenci\u00f3 i de protecci\u00f3 per a la represa de les activitats de la Diputaci\u00f3 de Barcelona amb car\u00e0cter general en el proc\u00e9s de desescalada del confinament provocat per la COVID-19<\/em>, el personal de la Diputaci\u00f3 pot demanar passar a prestar serveis en la\u00a0<strong>modalitat no presencial<\/strong>\u00a0per motius de conciliaci\u00f3:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Perqu\u00e8 conviuen amb fills\/filles menors\u00a0 (de 16 anys)<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Perqu\u00e8 conviuen amb gent gran dependent o persones amb discapacitat i\/o depend\u00e8ncia.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">En el sup\u00f2sit que les funcions del\u00a0 lloc\u00a0 de\u00a0 treball\u00a0 no\u00a0 siguin\u00a0 compatibles\u00a0 amb\u00a0 la modalitat de treball a dist\u00e0ncia, es concedir\u00e0 el perm\u00eds regulat a l\u2019article 48 j) del\u00a0<em>Real Decreto Legislativo 5\/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto B\u00e1sico del Empleado P\u00fablico.<\/em><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La concessi\u00f3 d\u2019aquest perm\u00eds est\u00e0 condicionat al tancament del centre educatiu, del centre que tenen cura de la gent gran o de les persones amb discapacitat i\/o depend\u00e8ncia.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>TAMB\u00c9 PELS SERVEIS ESSENCIALS<\/strong> Es mant\u00e9 tamb\u00e9 la possibilitat que el\u00a0<strong>personal anomenat essencial<\/strong>\u00a0(que no pugui treballar en la modalitat no presencial) tamb\u00e9 pugui obtenir el perm\u00eds 48j. A curt termini, no hi ha una previsi\u00f3 de que els centres educatius tanquin de manera general. Per tant, nom\u00e9s haurem de fer front a tancaments espec\u00edfics de determinats col\u00b7legis o aules. Tenint en compte aquest fet, \u00e9s dif\u00edcil imaginar que la concessi\u00f3 d\u2019aquest perm\u00eds a algunes persones que ho puguin necessitar puntualment afecti les \u201cnecessitats del servei\u201d. Aix\u00ed ho hem manifestat a la reuni\u00f3. En qualsevol cas,\u00a0<strong>feu sempre la petici\u00f3<\/strong>\u00a0i exigiu del vostre referent de RH una <strong>resposta escrita<\/strong>. Quedem a la vostra disposici\u00f3 en cas de dubte.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>ATENCI\u00d3! MOLT IMPORTANT<\/strong><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Conviure<\/strong>\u00a0amb fills menors o gent gran \u00e9s un\u00a0<strong>element essencial<\/strong>\u00a0per a la concessi\u00f3 del perm\u00eds. Si aquest \u00e9s el teu cas, no deixis d\u2019omplir la declaraci\u00f3 responsable i fer-la arribar al teu servei.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Nom\u00e9s ha de fer la petici\u00f3<\/strong><strong>,\u00a0<\/strong>qui hagi estat designat\/ada pel seu comandament per a\u00a0<strong>reincorporar-se\u00a0<\/strong>al seu lloc de treball\u00a0<strong>de manera PRESENCIAL.<\/strong><\/span><\/li>\n<li style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El\u00a0<\/span><strong style=\"color: #000000;font-family: arial, helvetica, sans-serif\">personal que treballa a dist\u00e0ncia<\/strong><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">\u00a0que conviu amb fills\/filles menors o gent gran dependent o persones amb discapacitat i\/o depend\u00e8ncia\u00a0<\/span><strong style=\"color: #000000;font-family: arial, helvetica, sans-serif\">t\u00e9 dret al que indica l\u2019article 3.4 del protocol:\u00a0<\/strong><em style=\"color: #000000;font-family: arial, helvetica, sans-serif\">\u201cEls empleats i empleades que treballin mitjan\u00e7ant modalitats no presencials hauran de realitzar la jornada assignada al lloc de treball que ocupen, sense perjudici que\u00a0<strong>adaptin el seu horari per poder conciliar<\/strong>\u00a0la se<span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">va vida personal i professional\u201d\u00a0<\/span><\/em><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">(aix\u00f2 significa rebre un nombre de tasques raonables, ajustades a la teva situaci\u00f3 i pactar un horari definit diferent, si ho necessites, al de la teva jornada ordin\u00e0ria). Per exemple, en el cas dels centres d&#8217;ensenyament, \u00e9s possible que us demanin que reenvieu el mailing o notificaci\u00f3 rebuda pel col\u00b7legi.\u00a0<\/span><\/li>\n<li style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Recordeu que el perm\u00eds retribu\u00eft 48j es pot <strong>sol\u00b7licitar<\/strong> sempre que <strong>us designin per prestar serveis de manera presencial. <\/strong>Cada servei us donar\u00e0 les indicacions del procediment a seguir.\u00a0<\/span><\/li>\n<li style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Una vegada acreditada la situaci\u00f3 de necessitat per conciliaci\u00f3, correspondr\u00e0 a cada servei la decisi\u00f3 de si l\u2019empleat o empleada prestar\u00e0\u00a0<strong>servei de manera no presencial o es concedir\u00e0 el perm\u00eds.<\/strong><\/span><\/li>\n<li style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Els empleats o empleades que gaudeixin del perm\u00eds <strong>poden ser requerits de manera puntual, temporal o permanent pels seus comandaments\u00a0<\/strong>per a treballar en la\u00a0<strong>modalitat a dist\u00e0ncia<\/strong> sempre que les tasques encomanades estiguin relacionades amb les funcions del seu lloc de treball.\u00a0<\/span><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Quan el\u00a0<strong>requeriment<\/strong> de treball no presencial sigui\u00a0<strong>permanent<\/strong>, el perm\u00eds atorgat inicialment\u00a0<strong>es deixar\u00e0 en suspens<\/strong>\u00a0durant el temps que dur\u00ed aquest
