style=\"text-align: justify\"><span style=\"font-family: 'arial black', sans-serif;color: #000000;font-size: 16px\">COM S&#8217;ACTIVA EL PROCEDIMENT DE DENUNCIA?<\/span><\/li>\n<\/ul>\n<p treball ha de prevenir-se i tractar-se si es produeix, ja que atempta contra la dignitat personal i professional, la protecci\u00f3 dels drets inviolables de les persones, i pot causar danys rellevants en la salut f\u00edsica i psicol\u00f2gica.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;font-size: 20px\"><strong>Cap agressi\u00f3 pot ser ignorada ni tolerada!<\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">\u00c9s per aix\u00f2 que <strong>CCOO-Diba va participar a la negociaci\u00f3 i finalment acordar un protocol<\/strong> que ha de permetre al personal de la Diputaci\u00f3 de Barcelona (amb independ\u00e8ncia del tipus de relaci\u00f3 jur\u00eddica i la seva durada) prevenir, detectar i erradicar els riscos psicosocials davant conductes que puguin comportar assetjament sexual, per ra\u00f3 de sexe i per identitat de g\u00e8nere i orientaci\u00f3 sexual (inclou a les empreses externes contractades per la corporaci\u00f3 o d\u2019altres administracions p\u00fabliques que d\u2019una persona, o de crear-li un entorn intimidatori, hostil, degradant, humiliant, ofensiu o molest.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, Situaci\u00f3 en la qual es trobi una persona que \u00e9s, ha sigut o que pugui ser tractada per la identitat de g\u00e8nere i l\u2019orientaci\u00f3 sexual d\u2019una manera menys favorable que una altra en una situaci\u00f3 an\u00e0loga.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Discriminaci\u00f3 indirecta. Situaci\u00f3 en la qual una disposici\u00f3, un criteri, una interpretaci\u00f3 o una pr\u00e0ctica presumiblement neutres poden ocasionar en lesbianes, gais, bisexuals, transsexuals o intersexuals (LGTBI) un desavantatge particular respecte de persones que no ho s\u00f3n.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Discriminaci\u00f3 per associaci\u00f3. iniciar\u00e0 la tramitaci\u00f3 de la investigaci\u00f3 pertinent a efecte de determinar si existeix o no assetjament sexual, per ra\u00f3 de sexe o per identitat de g\u00e8nere i orientaci\u00f3 sexual:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Emetr\u00e0 un informe motivat i vinculant sobre l\u2019exist\u00e8ncia o no d\u2019assetjament sexual.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Aquest, valorar\u00e0 la concurr\u00e8ncia de causes agreujants i haur\u00e0 de contenir dades relatives a la identificaci\u00f3 de les persones implicades en el procediment del qual ha conegut.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Si l\u2019informe de la CTI <strong>conclou l\u2019exist\u00e8ncia d\u2019una situaci\u00f3 d\u2019assetjament<\/strong> sexual, per ra\u00f3 de sexe o per identitat de g\u00e8nere i orientaci\u00f3 sexual, s\u2019iniciar\u00e0 el corresponent <strong>expedient sancionador (disciplinari, helvetica, sans-serif;color: #000000\">Quan l\u2019estudi d\u2019un cas conclogui que com a conseq\u00fc\u00e8ncia de l\u2019assetjament, s\u2019han produ\u00eft danys a la salut, tant f\u00edsics com si s\u00f3n ps\u00edquics, es consideraran un <strong>accident laborals als efectes dels que estableix la normativa de la SS vigent<\/strong> i derivar\u00e0 la persona afectada a la m\u00fatua
