Sense dita regulaci\u00f3, CCOO denunci\u00e0vem que el personal integrat a les borses patia una evident manca de garanties que es tradu\u00efa en alguns casos en arbitrarietats. L\u2019any 2016 no es va poder arribar a cap acord i la corporaci\u00f3 va donar per finalitzada la negociaci\u00f3. No obstant aix\u00f2 la nostra lluita va continuar, per exemple als tribunals (<a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/03\/mem10-reglament_borses.pdf\"><span style=\"color: #0000ff;font-family: 'arial black', sans-serif\">Cliqueu aqu\u00ed<\/span><\/a> per a + info) o tamb\u00e9 aconseguint resoluci\u00f3 del GAIP (<a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/03\/mem11-gaip.pdf\"><span style=\"color: #0000ff;font-family: 'arial black', sans-serif\">Cliqueu aqu\u00ed<\/span><\/a> per a + info), ect.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>LA PROPOSTA ACTUAL (2019)<\/strong>, cont\u00e9 elements essencials per a CCOO:<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Agilitzar els mecanismes d\u2019acc\u00e9s<\/strong> a les borses per a que aquestes puguin donar respostes immediates a les necessitats de personal (no realitzar substitucions suposa sobrec\u00e0rregues de treball que afecta seriosament la salut)<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Garantir la perman\u00e8ncia<\/strong> indefinida del personal que actualment forma part d\u2019una borsa (Diputaci\u00f3, consorcis i organismes adherits al nostre Acord Marc), que ja treballa o ha treballat a la Diba. Es tracta de no haver de passar m\u00e9s proves (te\u00f2riques i\/o pr\u00e0ctiques) per formar part de la borsa de l\u2019\u00e0mbit funcional del lloc de treball<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"color: #000000\"><strong><span style=\"font-family: arial, helvetica, sans-serif\">\u00a0<\/span><span style=\"font-family: arial, helvetica, sans-serif\">Per a CCOO \u00e9s fonamental que qualsevol regulaci\u00f3 garanteixi:<\/span><\/strong><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Els principis de<strong> PUBLICITAT, IGUALTAT, CAPACITAT I M\u00c8RIT <\/strong>per a la crida<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Que tot nomenament per ocupar vacant (fins a provisi\u00f3) s\u2019ofereixi tenint en compte el millor posicionament en el r\u00e0nquing de la borsa<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El <strong>control i supervisi\u00f3 per part dels sindicats<\/strong> de la gesti\u00f3 de les borses<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Hem de dir que observem actualment, per part de la corporaci\u00f3, <strong>un posicionament m\u00e9s flexible<\/strong> respecte a donar resposta a aquestes exig\u00e8ncies: proposen una <em>Comissi\u00f3<\/em> amb reunions bimensuals on els sindicats puguem \u201cfiscalitzar\u201d la gesti\u00f3.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Esperem rebre per escrit les atribucions i compet\u00e8ncies reals d\u2019aquesta comissi\u00f3 per poder fer una valoraci\u00f3 definitiva.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Ens han anunciat que la DSRH recuperar\u00e0 les anomenades borses \u201cdescentralitzades\u201d (RESPIR, XBM, etc). Aix\u00f2 dona resposta al que CCOO, entre d\u2019altres sindicats, deman\u00e0vem des de fa temps pel gran nombre d\u2019incid\u00e8ncies detectades.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;background-color: #ffff00;font-size: 20px\"><u>APROVAT EL CALENDARI 2020\u00a0<\/u> <span style=\"background-color: #ffffff;color: #000000\"><strong><span style=\"font-family: arial, helvetica, sans-serif\">(<a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/11\/calendari-2020-1.pdf\"><span style=\"color: #0000ff;font-family: 'arial black', sans-serif\">Cliqueu aqu\u00ed<\/span><\/a> per veure TAULA-RESUM)<\/span><\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;font-size: 20px\"><span style=\"text-decoration: underline\"><strong>226 JORNADES A TREBALLAR<\/strong><\/span><strong><span style=\"text-decoration: underline\">\u00a0\u00a0<\/span> \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong><\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;font-size: 20px\">1582 hores\u00a0 (jornada general 35.00 h)<\/span><\/p>\n<p style=\"text-align: center\"><span style=\"font-family: arial, helvetica, sans-serif;font-size: 20px;color: #000000\">1.695 hores\u00a0 (jornada especial 37.30 h)<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">15 d\u2019agost i 26 de desembre cauen en dissabte i generen 2 dies de dispensa per compensaci\u00f3 de festiu. La concessi\u00f3 dels dies de dispensa garanteix que gaudim de 14 festius\/any.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Heu de tenir present que els dies d\u2019AP i la resta de permisos s\u00f3n considerats temps efectiu de treball (tamb\u00e9 els dies de baixes m\u00e8diques o IT).<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Aix\u00ed doncs, els dies que aneu a treballar, m\u00e9s els dies d\u2019AP i permisos a qu\u00e8 teniu dret (i els dies de baixa), <strong><u>mai haurien de sumar m\u00e9s<\/u><\/strong> <strong><u>de 226 jornades.<\/u><\/strong><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Per al torn de nit,<\/strong> CCOO i UGT hem coincidit en la petici\u00f3 que es permeti que les hores de permisos (582J\/515) que no arribin a completar una jornada sencera (10 hores) es puguin \u201cajuntar\u201d amb altres permisos (AM, hores de compensaci\u00f3 per cursos, hores en escreix, etc), per evitar que el personal hagi d\u2019anar a treballar una nit nom\u00e9s per unes poques hores.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">A m\u00e9s, la part social hem donat la conformitat tamb\u00e9 el <strong>calendari dels Oficials Especial- conductors\/es<\/strong>.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;font-size: 20px\"><strong>CCOO hem demanat:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Treballar les mateixes jornades (225) que els anys anteriors. (L\u2019any 2020 t\u00e9 366 dies). Es a dir, treballar 1 dia menys del que es proposa.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Recuperar els dos dies de perm\u00eds anomenats de \u201cdispensa extraordinaris\u201d (24\/31 desembre) pactats al calendari del 2014.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Limitar (i\/o compensar) el nombre de jornades del personal XBM. Actualment, bona part d\u2019aquest personal supera les 226 jornades\/any.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"text-decoration: underline;font-family: 'arial black', sans-serif\"><span style=\"font-size: 20px;color: #0000ff;background-color: #ffff00;text-decoration: underline\"><strong>MILLORA SOCIAL PER EDAT<\/strong><\/span><\/span> <span style=\"font-family: 'arial black', sans-serif\"><span style=\"font-size: 20px;color: #0000ff;background-color: #ffff00\"><strong>\u00a0<\/strong><\/span><\/span><span style=\"text-decoration: underline;font-family: 'arial black', sans-serif\"><span style=\"font-size: 20px;color: #0000ff;background-color: #ffff00;text-decoration: underline\"><strong>(PETICI\u00d3 DE CCOO)<\/strong><\/span><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li style=\"list-style-type: none\">\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif\">E<span style=\"color: #000000\">xigim que la Diputaci\u00f3 <strong>pagui la <em>Millora Social per Edat<\/em> a tot el personal que compleix els requisits <\/strong>contemplats a l\u2019acord<\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li style=\"list-style-type: none\">\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Mostrem la nostra ferma oposici\u00f3 a la interpretaci\u00f3 unilateral inclosa al decret que diu:\u00a0 \u201c<em>la resoluci\u00f3 de la millora ara sol\u00b7licitada resta condicionat a la resoluci\u00f3 en via judicial dels processos engegats contra la Diputaci\u00f3<\/em>\u201d<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li style=\"list-style-type: none\">\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>No es pot \u201ccastigar\u201d qui exerceix leg\u00edtimament la defensa dels seus drets,<\/strong> ni tampoc amena\u00e7ar als que m\u00e9s endavant ho vulguin fer. A m\u00e9s, s\u2019ha actuat d\u2019aquesta manera, apel\u00b7lant a una <strong><u>suposada<\/u><\/strong> <strong><u>incompatibilitat,<\/u><\/strong> \u00e9s a dir, no es poden cobrar dos conceptes \u201ciguals\u201d (<em>Premis per Anys <\/em>i <em>Millora Social per Edat).<\/em> Per\u00f2, preguntem: qui ha interposat una demanda, ja ha cobrat els <em>Premis<\/em>? NO! Es pot establir una restricci\u00f3 d\u2019un dret, d\u2019una expectativa, de manera preventiva? CCOO diem rotundament que no!!!<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>LA GOTA QUE FA VESSAR EL GOT<\/strong> El que resulta m\u00e9s greu de tot plegat, i analitzant els casos denegats, observem que fins i tot la <strong>interpretaci\u00f3<\/strong> corporativa <strong>restrictiva d\u2019incompatibilitat NO APLICA<\/strong>. Passat alguns mesos no tenim cap resposta.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Pel que hem sabut, la resoluci\u00f3 de les demandes dels <strong>PREMIS PER ANYS<\/strong> pot trigar fins a final de 2020 (sense comptar que es podria recorre una possible sent\u00e8ncia favorable a les demandes del personal). Fins llavors, qu\u00e8 ha de fer la gent que va demanar la \u201cMillora Social per edat\u201d? Resignar-se?<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Ja li avancem a la corporaci\u00f3: <span style=\"font-family: 'arial black', sans-serif\"><strong><u>CCOO no ens quedarem de bra\u00e7os creuats<\/u><\/strong><\/span> quan tenim clar que s\u2019est\u00e0 vulnerant uns drets de manera absolutament incomprensible i injusta.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center\"><span style=\"text-decoration: underline\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size:
