AB\u00daS DE LA TEMPORALITAT.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 20px\"><strong><u>Introducci\u00f3<\/u><\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong><span style=\"text-decoration: underline\">EN PRIMER LLOC<\/span>, s\u2019ha de recordar<\/strong> que totes les demandes interposades per a la utilitzaci\u00f3 abusiva de les relacions de treball temporal sorgeixen com a conseq\u00fc\u00e8ncia de <strong>L\u2019ACORD MARC SIGNAT entre la CES (<\/strong><em>Confederaci\u00f3 Europea de Sindicats<\/em>, organitzaci\u00f3 presidida per CCOO en el moment de la signatura), <strong>la UNICE<\/strong> (<em>Uni\u00f3 de confederacions industrials i empresarials d\u2019Europa)<\/em> i el<strong> CEEP<\/strong> (Associaci\u00f3 Europa d\u2019empreses p\u00fabliques i serveis d\u2019inter\u00e8s general).<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>En relaci\u00f3 a l\u2019Acord Marc<\/strong> entre la CES, la UNICE i el CEEP sobre el treball de durada determinada <strong>es va fer la Directiva 1999\/70\/CE<\/strong> per a la seva aplicaci\u00f3 a nivell comunitari mitjan\u00e7ant una decisi\u00f3 del Consell a proposta de la Comissi\u00f3 Europea.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong><span style=\"text-decoration: underline\">EN SEGON LLOC<\/span>, recordem<\/strong> les mocions presentades en el Ple corporatiu de la Diputaci\u00f3 de Barcelona i aprovades per unanimitat per tots els grups pol\u00edtics de Diba. Mocions promulgades per la secci\u00f3 sindical de CCOO a la Diputaci\u00f3 de Barcelona dins d\u2019una estrat\u00e8gia per anul\u00b7lar les \u201ctaxes de reposici\u00f3\u201d imposades i exigir convocat\u00f2ries d\u2019Oferta P\u00fablica.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/08\/mocio-ocupacio-diba.jpg\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff\">Cliqueu<\/span><\/a> sobre la imatge per llegir moci\u00f3.<\/span><\/p>\n<p style=\"text-align: justify\"><a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/08\/mocio-ocupacio-diba.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4536 aligncenter\" src=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/08\/mocio-ocupacio-diba-169x300.jpg\" alt=\"\" width=\"169\" height=\"300\" srcset=\"https:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/08\/mocio-ocupacio-diba-169x300.jpg 169w, https:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/08\/mocio-ocupacio-diba-576x1024.jpg 576w, https:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/08\/mocio-ocupacio-diba.jpg 750w\" sizes=\"auto, (max-width: 169px) 100vw, 169px\" \/><\/a><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><span style=\"text-decoration: underline\"><strong>EN TERCER LLOC<\/strong><\/span>, hem de tenir en compte els dos acords d\u2019\u00e0mbit estatal signats a la Mesa General de la Funci\u00f3 Publica per CCOO, UGT i CSIF per a convocar totes les places ocupades fins a arribar a una taxa d\u2019interinitat per sota del 8%. Amb aquest acord, es trencaven les limitacions de les taxes de reposici\u00f3 imposades a les diferents LPGE.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><span style=\"text-decoration: underline\"><strong>EN QUART LLOC<\/strong><\/span>, hem de recordar l\u2019Acord assolit l\u2019any 2016 sobre el personal inter\u00ed i que va suposar l\u2019aplantillament \u201cfins a provisi\u00f3 reglamentaria\u201d de tot el personal inter\u00ed que ocupava una pla\u00e7a vacant. Entorn a 400 persones es van veure beneficiades. All\u00f2 que en d&#8217;altres administracions va suposar iniciar un procediment judicial, a la Diba es va aconseguir gr\u00e0cies a aquest acord: Una pla\u00e7a indefinida \u201cno fixa\u201d, \u00e9s a dir, fins a la \u201cprovisi\u00f3 reglament\u00e0ria\u201d de la pla\u00e7a a torn lliure. Es van acabar amb els nomenaments (mal anomenats contractes) precaris i\/o de mesos per a convertir-los a indefinits.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><span style=\"text-decoration: underline\"><strong>EN CINQU\u00c8 LLOC<\/strong><\/span>, s\u2019ha signat un acord que dona seguretat de continu\u00eftat al personal de m\u00e9s de 55 anys. Tot i que ens hagu\u00e9s agradat arribar als 50 anys, aquest acord permet que el personal amb m\u00e9s edat pugui tenir garanties de continu\u00eftat.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 20px\"><u>Situaci\u00f3 actual<\/u><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">S\u2019ha aconseguit paralitzar la publicaci\u00f3 de l\u2019Oferta P\u00fablica d\u2019Ocupaci\u00f3 gr\u00e0cies a la mobilitzaci\u00f3 del personal inter\u00ed i l\u2019acci\u00f3 unit\u00e0ria dels 4 sindicats culminant amb una tancada a Can Serra. CCOO estem satisfets i satisfetes pels resultats i seguirem afavorint l\u2019entesa i acci\u00f3 amb la resta de forces sindicals.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">S\u2019ha de tenir en compte que el calendari de negociaci\u00f3 de les bases de l\u2019Oferta Publica coincideix amb els procediments judicials oberts sobre el personal inter\u00ed en el Tribunal Europeu. El pronunciament judicial i la sent\u00e8ncia sembla que es produiran entre <strong>setembre i novembre<\/strong> de 2019.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La Mesa General de Negociaci\u00f3 de Diputaci\u00f3 de Barcelona es constituir\u00e0 previsiblement entorn a la <strong>segona quinzena de setembre <\/strong>i per tant, ja es podr\u00e0 \u201ciniciar\u201d la negociaci\u00f3 de l\u2019Oferta Publica. Negociaci\u00f3 que ja avancem que trigar\u00e0 setmanes o mesos. Es per aix\u00f2 que, qualsevol acord i\/o publicaci\u00f3 de les bases haur\u00e0 de tenir necess\u00e0riament en compte els pronunciaments judicials. Tenim fins a final d\u2019any per aclarir el panorama i prendre les decisions oportunes.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 20px\"><strong>Informaci\u00f3 relacionada amb les assemblees conjuntes entre CCOO, UGT, I-CSC i CGT:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Es va prendre la decisi\u00f3 de paralitzar la publicaci\u00f3 de l\u2019Oferta Publica d\u2019Ocupaci\u00f3 (cosa que ja hem aconseguit).<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Vam fer nostres els \u201cmarges\u201d negocials per a la Mesa de Negociaci\u00f3 (els quals ens sentim molt c\u00f2modes):<\/span>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">M\u00e0xims \u00e0 EBEP 61.6 (Concurs de m\u00e8rit).<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">M\u00ednims \u00e0 Bases semblants a la Convocat\u00f2ria de <em>consolidaci\u00f3 de l\u2019ocupaci\u00f3<\/em>.<\/span>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Des de CCOO impulsarem anar m\u00e9s enll\u00e0 d&#8217;aquestes bases fixant-nos en aconseguir bases semblants a les de l\u2019Ajuntament de Barcelona (no puntuen els treballs en l\u2019\u00e0mbit privat).<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Aconseguir que el proc\u00e9s d\u2019oposici\u00f3 no sigui eliminatori.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Que la formaci\u00f3 de menys de 10 hores computi.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Entre altres propostes&#8230;<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Hi ha prevista una reuni\u00f3 interna a CCOO Catalunya per posar en com\u00fa les bases de les diferents administracions. Segur que d&#8217;aquesta manera podrem trobar moltes m\u00e9s idees per a beneficiar al personal inter\u00ed intern de la Diba.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"text-decoration: underline\"><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 20px;text-decoration: underline\">Altres aspectes:<\/span><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">L\u2019article 61.6 de l\u2019EBEP diu: \u201c<em>Los sistemas selectivos de funcionarios de carrera ser\u00e1n los de oposici\u00f3n y concurso-oposici\u00f3n que deber\u00e1n incluir, en todo caso, una o varias pruebas para determinar la capacidad de los aspirantes y establecer el orden de prelaci\u00f3n. <strong>S\u00f3lo en virtud de ley podr\u00e1 aplicarse, con car\u00e1cter excepcional<\/strong>, el sistema de concurso que consistir\u00e1 \u00fanicamente en la valoraci\u00f3n de m\u00e9rito\u201d.<\/em><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fem evident que per a que el sistema de selecci\u00f3 a l\u2019oferta publica sigui el sistema de concurs de m\u00e8rit es necessari que s\u2019habiliti mitjan\u00e7ant una llei estatal.\u00a0 De fet el Govern de <strong>Can\u00e0ries<\/strong>, que va tirar endavant una convocat\u00f2ria en aquest sentit, ha tingut que fer marxa enrere ja que un govern auton\u00f2mic no t\u00e9 potestat per fer-ho.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">A <strong>Catalunya<\/strong>, mitjan\u00e7ant la Moci\u00f3 89\/XII sobre la precarietat laboral, en el punt 11 es deia: <em>\u201cAprovar durant l\u2019any 2019 un decret llei perqu\u00e8, en aplicaci\u00f3 de l\u2019article 61.6 de l\u2019EBEP, els processos de selecci\u00f3 d\u2019ocupaci\u00f3 p\u00fablica reservin, com a mesura excepcional, places destinades a l\u2019estabilitzaci\u00f3 i la consolidaci\u00f3 d\u2019ocupaci\u00f3 temporal dels treballadors de m\u00e9s edat i m\u00e9s antiguitat mitjan\u00e7ant el sistema de concurs de m\u00e8rits<\/em>\u201d. Va ser una moci\u00f3 que van aprovar tots els grups parlamentaris menys JxCat i ERC. Ara, el Govern de la Generalitat diu que es inviable tirar endavant una convocat\u00f2ria d\u2019OPO ja que no tenen potestat per fer-ho. Afirma que seria inconstitucional.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">A la llum d\u2019aquests fets, nom\u00e9s queda esperar el pronunciament judicial i\/o un canvi normatiu via negociaci\u00f3 a la Mesa General de la Funci\u00f3 P\u00fablica.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"text-decoration: underline;color: #0000ff\"><span style=\"font-family: 'arial black', sans-serif;font-size: 20px\"><strong>Per tant, com a assemblea d\u2019afiliats i afiliades de CCOO a la Diputaci\u00f3 es demana prendre resoluci\u00f3 respecte al full de ruta a seguir:<\/strong><\/span><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Anar a la Mesa de Negociaci\u00f3 amb els marges:<\/span>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">M\u00e0xims \u00e0 EBEP 61.6\u00a0 (Concurs de m\u00e8rit).<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">M\u00ednims \u00e0 Bases semblants a la Convocat\u00f2ria de <em>consolidaci\u00f3 de l\u2019ocupaci\u00f3<\/em>.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Bases semblants a les de l\u2019Ajuntament de Barcelona (no puntuen els treballs en l\u2019\u00e0mbit privat). A m\u00e9s d\u2019altres propostes que puguin afavorir el personal.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Anar a exigir l\u2019aplicaci\u00f3 de l\u2019article 61.6 sempre que tinguem la seguretat jur\u00eddica que la convocat\u00f2ria no ser\u00e0 impugnable. Aix\u00f2 passaria nom\u00e9s per un pronunciament judicial i\/o un canvi normatiu que l\u2019habiliti.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fem evident que dos Autonomies (Can\u00e0ries i Catalunya) no han pogut en aquest moment tirar endavant una convocat\u00f2ria amb el \u201cconcurs de m\u00e8rit\u201d. Tenint en compte aix\u00f2, no podem com \u201cAdministraci\u00f3 local\u201d i secci\u00f3 sindical a la Diputaci\u00f3 de Barcelona pretendre aprovar una cosa que sabem que altres administracions amb m\u00e9s \u201cpoder\u201d no ho han pogut tirar endavant. Seria impugnat immediatament. Per tant, CCOO a la Diba nom\u00e9s defensar\u00e0 l\u2019aplicaci\u00f3 de l\u2019article 61.6 si hi ha seguretat jur\u00eddica que ho avali.<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La negociaci\u00f3 es veu condicionada a la \u201ccaducitat\u201d de l\u2019Oferta Publica. No podem oblidar que si no publiquem abans del 31 de desembre de 2019, la convocat\u00f2ria es perdr\u00e0 (article 70 de l\u2019EBEP).<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Exigir al nostre sindicat sensibilitat envers al tema i a la situaci\u00f3 del personal afectat, m\u00e0xima pressi\u00f3 a nivell pol\u00edtic per donar una soluci\u00f3 digna a l\u2019ab\u00fas de la temporalitat i transmetre la voluntat que es treballi en el sentit d\u2019exigir a nivell confederal solucions relacionades amb l\u2019article 61.6 o d\u2019altres que puguin donar garanties de continu\u00eftat.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Per unanimitat, es resol <u>aprovar<\/u> aquest full de ruta.<\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><img loading=\"lazy\" \/><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Es conclou recordant que, des de la Federaci\u00f3 de Serveis a la Ciutadania (FSC) ens asseguren que qualsevol canvi normatiu respecte als sistemes de selecci\u00f3 que vinguin com a resultat d\u2019una sent\u00e8ncia judicial i\/o d\u2019una decisi\u00f3 del govern de l\u2019estat <u>HAUR\u00c0 DE SER<\/u> necess\u00e0riament negociada a la Mesa General de Negociaci\u00f3 de la Funci\u00f3 P\u00fablica i ser\u00e0 d\u2019aplicaci\u00f3 per a tot el personal.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">En tornar de vacances, esperem reunir-nos amb el nou govern de la Diputaci\u00f3 de Barcelona i els hi exigirem un comprom\u00eds ferm de negociaci\u00f3 de l\u2019oferta Publica d\u2019Ocupaci\u00f3.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Quedem doncs pendent de les noves informacions i\/o esdeveniments.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align:
