El premis haguessin pogut passar a ser m\u00f2duls especials de productivitat com recentment, davant el mateix problema que el nostre, va fer l\u2019Ajuntament de Sitges amb el vistiplau dels seus \u00f2rgans de regulaci\u00f3 i supervisi\u00f3.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>POSICIONAMENT DE CCOO DIBA<\/strong><\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Exigim que la Diputaci\u00f3 de Barcelona compleixi amb els acords signats i ratificats pel Ple corporatiu.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Si es volen fer modificacions, que es plantegin en seu de Mesa General de Negociaci\u00f3. El que no acceptem \u00e9s imposar nous criteris de manera unilateral com s\u2019ha anant fent des del mes de novembre, dia en que es va signar l\u2019Acord.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Exigim que <strong>la Diputaci\u00f3 pagui la Millora Social per edat a tot el personal que compleixi els requisits.<\/strong> Per tant, demanem que <span style=\"text-decoration: underline;background-color: #ffff00\"><strong>es faci efectiu tamb\u00e9 al personal que ha interposat una demanda al Contenci\u00f3s pel tema de l\u2019impagament dels Premis per Anys de Servei.<\/strong><\/span><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">En aquest moment, el decret que s\u2019ha fet posa el seg\u00fcent:<\/span><\/p>\n<p style=\"text-align: justify\"><a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2019\/07\/decret-premis.png\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4523 \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per tant, el que \u201c<em>la resoluci\u00f3 de la millora ara sol\u00b7licitada resta condicionat a la resoluci\u00f3 en via judicial dels processos engegats contra la Diputaci\u00f3<\/em>\u201d.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">L\u2019Acord inclou excepcions respecte al personal que tot i tenir la edat no percebr\u00e0 la Millora Social per Edat. <\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Ara b\u00e9, al novembre de 2018, la Diputaci\u00f3 de Barcelona ja tenia interposat les demandes al Contenci\u00f3 i <span style=\"text-decoration: underline\"><strong>mai va mostrar la seva voluntat que el proc\u00e9s juridic obert pels PREMIS fes impossible tenir dret a la MILLORA SOCIAL.<\/strong><\/span> Ans al contrari, sempre va quedar clar que era compatible exigir als tribunals els Premis per anys i tenir dret a percebre la nova Millora Per Edat.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Si posteriorment al cobrament de la Millora Social Per Edat hi ha una sent\u00e8ncia favorable sobre els Premis per Anys, doncs nom\u00e9s s\u2019ha d\u2019iniciar una regularitzaci\u00f3 tenint en compte que no es pot \u201ccobrar\u201d dos vegades pel mateix concepte.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Aix\u00ed doncs, amb el decret d\u2019exclusi\u00f3 del personal que t\u00e9 processos engegats contra la Diputaci\u00f3, es mostra <strong>una clara mal fe negocial imposant unes restriccions preventives no pactades amb els signants de l\u2019acord.<\/strong><\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"background-color: #ffff00\"><strong><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Demanem A nou EQUIP DE GOVERN donar soluci\u00f3 a aquesta situaci\u00f3 de manera immediata.<\/span><\/strong><\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\"
