complement <\/span><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">al sistema de millora social que ja teniem fins ara i per tant, <\/span><span style=\"font-family: arial, helvetica, sans-serif;background-color: #ffff00\"><strong>tamb\u00e9 s&#8217;haur\u00e0 de justificar despesa per percebre els imports tenint en compte els conceptes que ja es feien servir fins ara.\u00a0<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><span style=\"font-family: 'arial black', sans-serif;font-size: 14pt;color: #0000ff\">MILLORA SOCIAL PER EDAT<\/span><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">CCOO hem fet un gran esfor\u00e7 en explicar i aclarir dubtes respecte a la proposta de <em>MILLORA SOCIAL PER EDAT<\/em>.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Hem fet <a href=\"https:\/\/diba.ccoo.cat\/impagaments-premis-sessions-informatives\/\"><span style=\"color: #0000ff;font-family: 'arial black', sans-serif\"><strong>sessions informatives<\/strong> <\/span><\/a>obertes i participatives per a tothom i hem at\u00e8s desenes de consultes durant tots aquest darrers mesos que ens han servit per a con\u00e8ixer el posicionament i la valoraci\u00f3 positiva del personal respecte a aquest acord <a href=\"https:\/\/diba.ccoo.cat\/impagaments-premis-sessions-informatives\/\"><span style=\"color: #0000ff;font-family: 'arial black', sans-serif\"><strong>(cliqueu per recordar sessions).<\/strong><\/span><\/a><\/span><\/p>\n<p><span style=\"color: #000000\"><span style=\"font-family: arial, helvetica, sans-serif\">Des de fa gaireb\u00e9 15 mesos, hem treballat a la Mesa de Negociaci\u00f3 per arribar a<\/span><strong><span style=\"font-family: arial, helvetica, sans-serif\">\u00a0una proposta d\u2019acord digne que pogu\u00e9s ser presentada, debatuda i validada en assemblea.<\/span> <\/strong><\/span><\/p>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=F9-292dd458\"><img loading=\"lazy\" decoding=\"async\" \/><\/a><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Arribats a aquest punt, us hem d\u2019informar que <strong><em>l\u2019Assemblea d\u2019afiliats i afiliades<\/em> de CCOO<\/strong> a la Diputaci\u00f3 de Barcelona <strong>ha pres la decisi\u00f3 de donar el seu vistiplau<\/strong> a la proposta de MILLORA SOCIAL PER EDAT i per tant us informem que <strong>en breu signarem<\/strong> aquest acord.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><span style=\"font-family: 'arial black', sans-serif;font-size: 14pt;color: #0000ff\"><strong>L\u2019ESTRAT\u00c8GIA DE CCOO: UNA <\/strong>ACTUACI\u00d3 GLOBAL DE\u00a0 NEGOCIACI\u00d3, MOBILITZACI\u00d3, ACCI\u00d3 SINDICAL I JUR\u00cdDICA<\/span>.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fruit del posicionament ferm de nom\u00e9s <strong>CCOO<\/strong> i CGT (<strong>CLIQUEU<\/strong> aqu\u00ed per llegir resum del que va succeir llavors), es va aconseguir:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La <strong>no suspensi\u00f3<\/strong> del nostre acord de manera <strong>unilateral<\/strong> i formalitzada <strong>en el Ple<\/strong> de la Diputaci\u00f3 de Barcelona a canvi de res.<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Conservar<\/strong> la partida pressupost\u00e0ria <strong>d\u20191.180.000<\/strong> <strong>\u20ac<\/strong> (fins ara per a <em>PREMIS PER ANYS<\/em>) per a dotar econ\u00f2micament un nou, alternatiu i possible acord al qu\u00e8 es pogu\u00e9s arribar (finalment ha estat el de <em>MILLORA SOCIAL PER EDAT)<\/em>.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Paral\u00b7lelament a la negociaci\u00f3 i les mobilitzacions, vam emprendre immediatament la via jur\u00eddica sent CCOO la primera secci\u00f3 sindical a la Diputaci\u00f3 que va interposar una demanda al Contenci\u00f3s-Administratiu.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Aix\u00ed doncs, el sindicat no \u00e9s nom\u00e9s un gabinet jur\u00eddic, com tampoc \u00e9s nom\u00e9s un equip negociador sin\u00f3 que \u00e9s ambdues coses i moltes m\u00e9s, combinat per arribar a les millors fites i garanties. Aquesta complicada negociaci\u00f3 n\u2019\u00e9s un clar exemple.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 14pt\"><strong>\u00c9S IMPORTANT VALORAR LA PROPOSTA DE <\/strong><strong><em>MILLORA SOCIAL PER EDAT<\/em><\/strong><strong> \u00a0TENINT EN COMPTE EL CONTEXT <\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Una vegada conegut l\u2019informe de l\u2019auditoria de la <em>Sindicatura de Comptes<\/em>, la Diputaci\u00f3 va informar que no es pagarien els PREMIS PER ANYS DE SERVEI.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Des de llavors i fins ara ning\u00fa ha cobrat res. Si no es tir\u00e9s endavant un nou acord alternatiu als PREMIS, tothom es quedaria igual: sense cobrar res. Nom\u00e9s ens quedaria la via jur\u00eddica, un proc\u00e9s individual d\u2019entre 1 i 4 anys (tenint en compte els possibles recursos).<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Deixar-ho tot a all\u00f2 que dictamini un jutge i no disposar d\u2019un nou acord alternatiu, d\u2019entrada suposa perdre la partida pressupost\u00e0ria (1.180.000 \u20ac \/ any) tot esperant que arribi una sent\u00e8ncia que tant podria ser favorable com desfavorable.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt\"><strong><span style=\"font-family: arial, helvetica, sans-serif;color: #0000ff\">SI ARRIB\u00c9S UNA SENT\u00c8NCIA FAVORABLE:<\/span><\/strong><\/span><\/p>\n<p><span style=\"color: #000000;font-size: 14pt\"><strong><span style=\"font-family: arial, helvetica, sans-serif\">No hi ha cap comprom\u00eds per part de la Diputaci\u00f3 que aix\u00f2 suposaria fer efectiu el pagament dels PREMIS PER ANYS DE SERVEI a tot el personal:<\/span><\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fins i tot, davant la nostra pregunta, la Diputaci\u00f3 no ha volgut donar cap garantia respecte a si davant una sent\u00e8ncia que els obligaria a pagar els PREMIS presentaria un recurs.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fixeu-vos que ja tenim data pel primer judici pels impagaments dels PREMIS: gener 2019. Si davant una sent\u00e8ncia que condemn\u00e9s la Diputaci\u00f3 a pagar la corporaci\u00f3 present\u00e9s un recurs, els terminis ens situarien ja en el seg\u00fcent mandat pol\u00edtic (hi ha eleccions municipals al maig 2019).<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El comprom\u00eds de l\u2019ACTUAL equip de govern \u00e9s de mantenir els 1.180.000 \u20ac. Quina garantia tenim que el pr\u00f2xim mandat es mantindr\u00e0 aquest comprom\u00eds. I si governa un altre partit?<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"font-family: arial, helvetica, sans-serif;color: #000000;font-size: 14pt\">Una sent\u00e8ncia favorable no significa que autom\u00e0ticament tothom cobri:<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Poden decidir anar pagant individualment en la mesura que una persona guany la demanda judicial que ha presentat. Cap garantia que es faci extensiu a tot el personal afectat.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;font-size: 14pt\"><strong><span style=\"color: #0000ff\">EL GABINET T\u00c8CNIC JUR\u00cdDIC DE CCOO FA LES SEG\u00dcENTS VALORACIONS RESPECTE ALS IMPAGAMENTS:<\/span><\/strong><\/span><\/p>\n<p><span style=\"color: #000000;font-size: 14pt\"><strong><span style=\"font-family: arial, helvetica, sans-serif\">Si el jutge <span style=\"text-decoration: underline\">entra<\/span> en el fons de la q\u00fcesti\u00f3 (recordeu que es tracta de si els PREMIS s\u00f3n retribuci\u00f3 o no):<\/span><\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Les <strong>possibilitats de guanyar<\/strong> la demanda s\u00f3n <strong>m\u00ednimes<\/strong>.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif;font-size: 14pt\"><strong>Si el jutge\u00a0<span style=\"text-decoration: underline\">NO entra<\/span> en el fons\u00a0de la q\u00fcesti\u00f3 i nom\u00e9s es pronuncia sobre el \u201cprocediment\u201d de suspensi\u00f3 dels pagaments dels premis:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Les possibilitats de guanyar la demanda s\u00f3n altes.<\/strong>\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">La Diputaci\u00f3 aprova els nostres Acords per decret del Ple corporatiu i de la mateixa manera els ha de suspendre. <\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Recordareu que el impagaments dels PREMIS van ser ordenats mitjan\u00e7ant un decret del diputat delegat de RRHH i no del Ple, un aspecte absolutament erroni.<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Per tant, guanyar la demanda pot significar nom\u00e9s que el jutge digui que la suspensi\u00f3 de l\u2019Acord no s\u2019ha fet b\u00e9.<\/strong> <\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Condemnar la Diputaci\u00f3 a seguir el procediment correcte de suspensi\u00f3 de l\u2019Acord, \u00e9s a dir, que es faci per decret del Ple.\u00a0Aix\u00ed doncs, existeix la possibilitat que guanyar una demanda no suposi que el denunciant cobri. Implicaria haver de presentar una nova demanda (tornar a la casella de sortida).<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Tamb\u00e9 podria ser que <strong>una persona guanyi la seva demanda, i un jutge condemni a la Diputaci\u00f3 a pagar perqu\u00e8 el procediment de suspensi\u00f3 no es va fer per decret de Ple.<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per\u00f2 a la vegada, l\u2019escrit de la sent\u00e8ncia pot deixar clar que respecte al fons de la q\u00fcesti\u00f3 (si els PREMIS s\u00f3n retribuci\u00f3 o no) que efectivament tenia ra\u00f3 la Diputaci\u00f3. Una sent\u00e8ncia en aquest sentit seria segurament aprofitada per mantenir la seva suspensi\u00f3 dels PREMIS a la resta d\u2019empleats\/des.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #0000ff;font-size: 14pt\"><strong>SI ARRIB\u00c9S UNA SENT\u00c8NCIA DESFAVORABLE:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Tot i que la resta de demandes seguirien el seu curs, \u00f2bviament les possibilitats de guanyar es veurien redu\u00efdes i l\u2019actitud de no pagament dels PREMIS per part de la Diputaci\u00f3 es veuria reafirmada.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Qualsevol possibilitat de negociar alternatives es veurien redu\u00efdes a la m\u00ednima expressi\u00f3.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 14pt\"><strong>SENT\u00c8NCIA FAVORABLE O DESFAVORABLE: MILLOR AMB 1.180.000\u20ac GARANTITS <\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">D\u2019acord amb el que hem exposat en l\u2019apartat anterior, tant si arriba una sent\u00e8ncia favorable com si \u00e9s desfavorable pels nostres interessos, estem conven\u00e7uts\/des que \u00e9s molt millor i avantatj\u00f3s tenir garantida la partida pressupost\u00e0ria d\u20191.180.000 \u20ac:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Una sent\u00e8ncia desfavorable reafirmaria la Diputaci\u00f3 en que el cam\u00ed de no pagar els PREMIS \u00e9s correcte.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Una sent\u00e8ncia favorable donaria l\u2019opci\u00f3 a decidir si volem tornar o no a la f\u00f3rmula dels PREMIS PER ANYS DE SERVEI.<\/span><\/li>\n<\/ul>\n<p><a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2018\/12\/llllllllllllllllllllllllllllllllllllllllllllllllllllllllll.png\"><img loading=\"lazy\" tampoc impedeix presentar les demandes de les persones que ABANS de la data de la signatura tenien dret als PREMIS (ho havien meritat).<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Ara b\u00e9, respecte als companys i companyes que tenien dret als PREMIS immediatament DESPR\u00c9S de la signatura, fixeu-vos que diu el PER ANYS i com a conseq\u00fc\u00e8ncia fa inviable utilitzar la via jur\u00eddica. Ara b\u00e9, s\u2019ha de tenir en compte que la nostra actuaci\u00f3 sindical ha combinat entre altres coses la negociaci\u00f3 i l\u2019acci\u00f3 jur\u00eddica.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Recordareu que els primers en patir els impagaments van ser els que tenien dret als PREMIS <strong>al juliol de 2017<\/strong>. Van ser doncs els primers en presentar demandes individuals. Heu de saber que ja hi ha data pel primer judici: <strong>gener de 2019<\/strong>. Per tant, com a m\u00ednim s\u2019ha de preveure en torn a <strong><u>1 any i mig per arribar a judici. <\/u><\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per tant, posant un exemple. Qui <strong>hauria de cobrar els PREMIS PER ANYS al mes de gener 2019<\/strong> hauria d\u2019interposar una demanda i <strong>esperar<\/strong> al menys fins al <strong>juny de 2020<\/strong> per arribar a judici i tenir opci\u00f3 a cobrar.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El que volem fer evident \u00e9s que, durant tot aquest temps, hi hauran moltes sent\u00e8ncies de totes les demandes fetes fins ara. Si una darrera l\u2019altre ens donen la ra\u00f3, aleshores no haur\u00e0 cap impediment legal per a tornar a la regulaci\u00f3 dels PREMIS PER ANYS com un dret vigent. Les centenars de demandes interposades al llarg del 2018 s\u00f3n m\u00e9s que suficient per a dirimir sobre la q\u00fcesti\u00f3.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 18pt\"><strong>CONCLUSI\u00d3<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per tant, <em>l\u2019Assemblea d\u2019afiliats i afiliades<\/em> donem el vistiplau a la proposta \u201c<em>Millora social per edat<\/em>\u201d pendents de com es desenvolupen els procediments judicials iniciats pel personal que ja ho havia meritat.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Recordeu que l\u2019estrat\u00e8gia de CCOO s\u2019ha de veure com una actuaci\u00f3 global de\u00a0 negociaci\u00f3, mobilitzaci\u00f3, acci\u00f3 sindical i jur\u00eddica. aix\u00f2, insistim de nou que no arribar a cap acord suposaria perdre la partida pressupost\u00e0ria d\u20191.180.000 \u20ac, seria com acceptar la suspensi\u00f3 <em>de facto i <\/em>deixar aquest assumpte al que exclusivament digui la just\u00edcia.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Aix\u00f2 suposaria resignar-nos a no exercir el nostre dret a la negociaci\u00f3 col\u00b7lectiva, suposaria no lluitar per a que no es vulneri la rellev\u00e0ncia que ha de tenir la nostra Mesa de Negociaci\u00f3 la qual \u00e9s l\u2019expressi\u00f3 de
