La condemna consisteix en el <strong>30% del rec\u00e0rrec en les prestacions de la Seguretat Social i una indemnitzaci\u00f3 de 100.000 euros<\/strong><\/span><\/p>\n<p><span style=\"color: #000000\"><span style=\"font-family: arial, helvetica, sans-serif\">El Tribunal Superior de Just\u00edcia de Castella i Lle\u00f3 (TSJCL) va confirmar l&#8217;exist\u00e8ncia de responsabilitat empresarial per <strong><u>falta de mesures seguretat i higiene<\/u><\/strong> en el treball en l&#8217;accident sofert per una empleada en una resid\u00e8ncia\u00a0<\/span><span style=\"font-family: arial, helvetica, sans-serif\">de Mombeltr\u00e1n (\u00c0vila).<\/span><\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">El 24 de desembre de 2013, la treballadora, de 41 anys, va patir un accident laboral quan, en incorporar a una usu\u00e0ria de la resid\u00e8ncia de gent gran, li va donar una estrebada a l&#8217;esquena que va causar una lesi\u00f3 que l&#8217;ha ocasionat una incapacitat permanent total, per la qual cosa es considera que va existir una manca de mesures de seguretat. \u00ab<em>No hi havia grua ni una altra persona que m&#8217;ajud\u00e9s, i en moure a la pacient em vaig fer mal en un disc, i ara tinc dues v\u00e8rtebres subjectes<\/em>\u00ab, va explicar l&#8217;afectada, que ha patit ja tres intervencions quir\u00fargiques i amb danys tamb\u00e9 a un menisc.<\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">La sent\u00e8ncia recull l&#8217;informe de la Inspecci\u00f3 de Treball, que declara que:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">No va existir una correcta avaluaci\u00f3 dels riscos ni planificaci\u00f3 preventiva del lloc de treball tot i estar identificats els riscos ergon\u00f2mics com postures for\u00e7ades i mobilitzaci\u00f3 de residents<\/span><\/li>\n<li><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">No existien recomanacions espec\u00edfiques relatives a les condicions particulars d&#8217;un determinat lloc de treball<\/span><\/li>\n<li><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">No s&#8217;havia impartit a la treballadora la formaci\u00f3 necess\u00e0ria sobre els riscos i tasques en la mobilitzaci\u00f3 de persones.<\/span><\/li>\n<li><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">No existia en l&#8217;empresa un procediment de treball clar que especifiqu\u00e9s les tasques que requerien la utilitzaci\u00f3 d&#8217;ajudes mec\u00e0niques o la necessitat d&#8217;emprar dues treballadores\u00bb.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">La Inspecci\u00f3 de Treball i la Seguretat Social va sancionar l&#8217;empresa amb <strong>una multa de 2.046 euros<\/strong>, declarant l&#8217;exist\u00e8ncia de <strong>responsabilitat empresarial per falta de mesures de seguretat i higiene en el treball<\/strong> en l&#8217;accident sofert per la treballadora.\u00a0 Les prestacions de la Seguretat Social seran incrementades en un 30% amb c\u00e0rrec a l&#8217;empresa i l&#8217;aplicaci\u00f3 del mateix increment respecte a les prestacions que, derivades de l&#8217;accident, poguessin recon\u00e8ixer-se en el futur.<\/span><\/p>\n<p><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 14pt\">D&#8217;aquesta not\u00edcia \u00e9s despr\u00e8n la necessitat que tots i totes les treballadores no callin davant la manca d&#8217;Avaluacions i \/ o d\u2019aplicaci\u00f3 de les mesures preventives dels Llocs de Treball.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span
