style=\"font-family: 'arial black', sans-serif;color: #0000ff\"><strong>Aprovat el <em>Protocol per a la\u00a0 prevenci\u00f3, detecci\u00f3, identificaci\u00f3 i actuaci\u00f3 de l\u2019assetjament sexual, per ra\u00f3 de sexe i per identitat i orientaci\u00f3 sexual de la Diputaci\u00f3 de Barcelona.<\/em><\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">En el seg\u00fcent enlla\u00e7 podeu trobar l\u2019Acord que CCOO hem signat:<\/span><\/p>\n<p><a style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Tenim el ple convenciment que aquest nou Protocol ser\u00e0 una eina \u00fatil per a lluitar contra les diferents tipologies d\u2019assetjament sexual, per identitat i orientaci\u00f3 sexual.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: 'arial black', sans-serif;color: #0000ff;font-size: 18pt\"><strong>ASPECTES DESTACABLES:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;font-size: 14pt;color: #000000\"><strong>Punt 5.2. a) Persones de refer\u00e8ncia<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000\"><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif\"><strong>Funcions:<\/strong><\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Informar i assessorar<\/strong> la persona afectada sobre els seus drets, sobre el contingut del protocol i les opcions i acciones que pot emprendre a l\u2019inici i durant tot el proc\u00e9s.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Proposar<\/strong> a la DSRH, si escau, l\u2019adopci\u00f3 de mesures cautelars i\/o preventives<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Investigar<\/strong> les possibles situacions d\u2019assetjament sexual, per ra\u00f3 de sexe o per identitat<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>\u00a0<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;font-size: 14pt;color: #000000\"><strong>Punt 5.2. i) Comissi\u00f3 T\u00e8cnica d\u2019Investigaci\u00f3 (CTI)<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000\"><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif\"><strong>Funcions de la CTI:<\/strong><\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Investigar<\/strong> les possibles situacions d\u2019assetjament sexual, per ra\u00f3 de sexe o per identitat de g\u00e8nere i orientaci\u00f3 sexual de les quals tingui coneixement, en el marc de la corporaci\u00f3.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Emetre informe <u>vinculant<\/u><\/strong> en relaci\u00f3 amb les situacions descrites a l\u2019apartat anterior sobre l\u2019exist\u00e8ncia o no d\u2019una situaci\u00f3 d\u2019assetjament sexual, per ra\u00f3 de sexe o per identitat de genere o orientaci\u00f3 sexual.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fer recomanacions, si escau, sobre les intervencions i mesures que s\u00f3n necess\u00e0ries.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Proposar a la DSRH, si escau, l\u2019adopci\u00f3 de mesures cautelars i\/o preventives<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;font-size: 14pt;color: #0000ff\"><strong>La proposta corporativa inicial a la negociaci\u00f3 era que:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif\">e<span style=\"color: #000000\">ls sindicats <strong><u>NO tingu\u00e9ssim pres\u00e8ncia<\/u><\/strong> ni com a <em>persona de refer\u00e8ncia<\/em> ni a la CTI<\/span><\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Des de CCOO ho ten\u00edem clar: <strong><span style=\"text-decoration: underline\">les possibilitats d\u2019arribar a un acord passaven nom\u00e9s per a tenir pres\u00e8ncia a ambd\u00f3s llocs<\/span><\/strong>. De fet, deman\u00e0vem que la CTI fos parit\u00e0ria: corporaci\u00f3 versus sindicats.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Davant la posici\u00f3 ferma de CCOO, a la darrera reuni\u00f3 de negociaci\u00f3, les representants de la Diputaci\u00f3 van proposar:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong><u>DUES persones de refer\u00e8ncia<\/u><\/strong> en lloc d\u2019UNA. Aix\u00ed, els i les representants sindicals pass\u00e0vem de ser mers espectadors <u>a ser-hi presents<\/u> com a <strong><em>agents de refer\u00e8ncia<\/em><\/strong> davant un cas d\u2019assetjament.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong><u>Que els sindicats tinguem<\/u><\/strong><u> <strong>pres\u00e8ncia a la CTI<\/strong><\/u> com a <strong>membre <u>de ple dret<\/u><\/strong><u>.<\/u> La part social pod\u00edem escollir una de les persones que en formar\u00e0 part amb veu i vot de la CTI i que tindr\u00e0 acc\u00e9s a tota la informaci\u00f3 dels casos que es produeixin.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Per tant, encara que el Protocol aprovat no recull <strong>TOTES<\/strong> les nostres demandes, creiem que l\u2019Acord <span style=\"text-decoration: underline\"><strong>cont\u00e9 elements crucials<\/strong><\/span>\u00a0(pres\u00e8ncia i veu) que ens permetr\u00e0 a la representaci\u00f3 de les treballadores i treballadors incidir de manera decisiva en els casos d\u2019assetjament sexual\u00a0 que es puguin detectar en el futur.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Cap cas quedar\u00e0 invisibilitzat. <strong>Mai m\u00e9s!<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"font-family: 'arial black', sans-serif;font-size: 14pt;color: #0000ff\"><strong>\u00c9S IMPORTANT RECORDAR COM HEM ARRIBAT FINS AQU\u00cd:<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El primer Pla d\u2019Igualtat Diba va ser aprovat a l\u2019Abril de 2015. Llavors, despr\u00e9s de presentar moltes altres esmenes, CCOO vam posar una condici\u00f3 per a donar el nostre vistiplau al Pla: que una de les moltes accions fos elaborar un protocol d\u2019assetjament sexual disgregat del d\u2019assetjament laboral. Condici\u00f3 que la Diba finalment va acceptar.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Fixeu-vos en el punt 9 del Pla d\u2019Igualtat:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Mesura 9:1.<\/strong>\u00a0\u00a0 Elaborar un<em> Protocol per prevenir, detectar i identificar situacions d\u2019assetjaments sexual, per ra\u00f3 de sexe, identitat i orientaci\u00f3 sexuals.<\/em><\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>Mesura 9.2<\/strong>. Difondre <em>el Protocol per prevenir, detectar i identificar situacions d\u2019assetjaments sexual, per ra\u00f3 de sexe, identitat i orientaci\u00f3 sexual.<\/em><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Amb la inclusi\u00f3 d\u2019aquestes mesures al Pla d\u2019Igualtat don\u00e0vem un pas endavant per\u00f2 no definitiu<strong>. Ara, calia elaborar, negociar i implementar el Protocol<\/strong>.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Hem de dir que les negociacions han sigut molt complicades. De fet, teniu en compte <strong>que s\u2019ha arribat a un Acord despr\u00e9s de gaireb\u00e9 2 anys de negociacions.<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">De fet, durant l\u2019any 2016, la voluntat corporativa va ser aprovar-lo sense que hi hagu\u00e9s hagut un veritable proc\u00e9s negociador. Davant les nostres protestes, es recondueix la situaci\u00f3 i el 19 de gener de 2017 s\u2019inicia el proc\u00e9s negociador. Proc\u00e9s que es desenvolup\u00e0 en el s\u00ed de la Comissi\u00f3 de Riscos Psicosocials, en el Comit\u00e8 de Seguretat i Salut (CSS) i que finalment, culmin\u00e0 en el s\u00ed de la Mesa General de Negociaci\u00f3 (MGN).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El present <em>Protocol per a la prevenci\u00f3, detecci\u00f3, identificaci\u00f3 i actuaci\u00f3 de l\u2019assetjament sexual, per ra\u00f3 de sexe i per identitat i orientaci\u00f3 sexual,<\/em> ha estat treballat amb els i les <em>Delegades de Prevenci\u00f3<\/em> en les reunions de la <em>Comissi\u00f3 de Riscos Psicosocials<\/em>, al <em>CSS<\/em> i a la <em>MGN<\/em> celebrades els dies:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>19 de gener, 09 de febrer, 31 de mar\u00e7, 26 de maig, 9 de juny i 22 de juny, 6 de juliol i 15 de setembre de 2017.<\/strong><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: 'arial black', sans-serif;font-size: 14pt;color: #0000ff\"><strong>CONCLUSIONS:<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Tal com el Pla d\u2019Igualtat 2015-2019 ens est\u00e0 permetent avan\u00e7ar en mat\u00e8ria d\u2019Igualtat de G\u00e8nere a la Diputaci\u00f3 de Barcelona, d\u2019igual manera <strong>estem conven\u00e7uts i conven\u00e7udes que el <em>Protocol <\/em><\/strong><em>per a la prevenci\u00f3, detecci\u00f3, identificaci\u00f3 i actuaci\u00f3 de l\u2019assetjament sexual, per ra\u00f3 de sexe i per identitat i orientaci\u00f3 sexual <\/em><strong><u>ser\u00e0 una eina decisiva<\/u><\/strong> per fer front al casos que es puguin donar d\u2019ara en endavant.<\/span><\/p>\n<p><a href=\"https:\/\/intradiba.diba.cat\/documents\/28776273\/101294137\/Acord+protocol+prevenci%C3%B3+assetjament+sexual\/e2fbc862-dd9d-472a-b3da-98fa36b1e0b2\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2537 aligncenter\" src=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2018\/09\/kkkkkkkkkkkkkkkkkkkk-204x300.png\" alt=\"\" width=\"204\" height=\"300\" srcset=\"https:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2018\/09\/kkkkkkkkkkkkkkkkkkkk-204x300.png 204w, https:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2018\/09\/kkkkkkkkkkkkkkkkkkkk.png 252w\" sizes=\"auto, (max-width: 204px) 100vw, 204px\" \/><\/a><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">La secci\u00f3 de CCOO a la Diputaci\u00f3 de Barcelona vam fer una aposta ferma fins aconseguir-lo. El cam\u00ed ha estat llarg i gens f\u00e0cil. El resultat final, \u00f2bviament \u00e9s millorable. Fixeu-vos que el punt 7 del Protocol contempla que se n\u2019haur\u00e0 de fer un SEGUIMENT, AVALUACI\u00d3 I REVISI\u00d3 si s\u2019escau.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">Tot i aix\u00f2, creiem que l\u2019actual Protocol ens permetr\u00e0 donar un pas endavant posant a l\u2019abast dels i de les treballadores una eina per fer front a conductes d\u2019assetjament sexual. Per la qual <strong>us animem que us familiaritzeu quan abans millor amb el protocol. <\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\"><strong><em>\u00a0<\/em><\/strong><\/span><span style=\"color: #0000ff;font-family: 'arial black', sans-serif;font-size: 14pt\"><strong>VOLEM EL <em><u>SEGON<\/u> PLA D\u2019IGUALTAT<\/em> DIBA (2019-2023):<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">La Secci\u00f3 de CCOO treballem i treballarem a la Comissi\u00f3 de\u00a0 Seguiment\u00a0 del <strong><em>primer Pla d\u2019Igualtat (2015-2019)<\/em><\/strong>, vetllant perqu\u00e8 es compleixin totes les accions previstes en el Pla.<\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">Ara b\u00e9, ja estem treballant en el proc\u00e9s d\u2019avaluaci\u00f3, diagnosi i elaboraci\u00f3 del <strong><em>segon Pla d\u2019Igualtat (2019-2023)<\/em><\/strong>.
