En aquest moment <strong><u>comen\u00e7a el termini<\/u><\/strong> per interposar les demandes.<\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\"><strong>ATENCI\u00d3!<\/strong> En el cas del recurs de reposici\u00f3, <u>nom\u00e9s tenim 1 mes<\/u> per presentar-lo al registre de la corporaci\u00f3 a comptar des de que hem rebut la resposta escrita.<\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">A la secci\u00f3 sindical <strong>disposem d\u2019un model de recurs de reposici\u00f3<\/strong> avalat pel Gabinet T\u00e8cnic Jur\u00eddic de CCOO Catalunya.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #0000ff;font-family: 'arial black', sans-serif;font-size: 14pt\">Mesos abans vaig realitzar la petici\u00f3 ordin\u00e0ria i ara ja he complert els 25, 30 o 35 anys de servei per\u00f2 encara no he rebut cap resposta escrita. Qu\u00e8 faig?<\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">Posa\u2019t en contacte amb nosaltres i analitzarem el teu cas.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #0000ff;font-family: 'arial black', sans-serif;font-size: 14pt\">He realitzat el recurs de reposici\u00f3, quin \u00e9s el seg\u00fcent pas?<\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">S\u2019ha de presentar el <strong><u>recurs <em>contenci\u00f3s administratiu<\/em><\/u><\/strong> dins dels terminis establerts:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\"><strong>SI REBEM RESPOSTA<\/strong> per part de Diputaci\u00f3 al nostre recurs de reposici\u00f3, aleshores tenim <strong>2 mesos des de la seva notificaci\u00f3 per presentar el <em>Contenci\u00f3s.<\/em><\/strong><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\"><strong>SI NO REBEM RESPOSTA<\/strong> per part de Diputaci\u00f3 al nostre recurs de reposici\u00f3 en el termini d\u20191 mes (silenci administratiu), aleshores es pot entendre com desestimat. En aquest moment \u00e9s quan comen\u00e7a el termini m\u00e0xim de <strong>6 mesos per presentar el <em>Contenci\u00f3s<\/em>.<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"color: #0000ff;font-family: 'arial black', sans-serif;font-size: 14pt\">Puc interposar directament un recurs contenci\u00f3s administratiu sense realitzar pr\u00e8viament el recurs de reposici\u00f3?<\/span><\/p>\n<p><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"color: #000000;font-family: arial, helvetica, sans-serif\">S\u00ed, ja que el <em>recurs de reposici\u00f3<\/em> \u00e9s potestatiu.
