Hem de recordar que <span style=\"color: #ff0000;font-size: 14pt\"><strong>els nostres acords s\u00f3n plenament vigents<\/strong> <\/span>(actualment en paper i per registre).<\/span><\/p>\n<p>CLIQUEU\u00a0 &#8211;&gt; (<a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2018\/03\/declaracio-responsable.pdf\">Declaraci\u00f3 responsable<\/a>) i (<a href=\"http:\/\/ccoo.app\/diputacio-de-barcelona\/wp-content\/blogs.dir\/6\/files\/sites\/186\/2018\/03\/sollicitud-premis-per-anys-de-servei.pdf\">sol\u00b7 licitud ordin\u00e0ria<\/a>)<\/p>\n<ol start=\"2\">\n<li><span style=\"font-family: 'arial black', sans-serif;color: #ff0000;font-size: 14pt\"><strong>RESOLUCI\u00d3 EXPRESSA (Resposta DiBa)<\/strong><\/span><\/li>\n<\/ol>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Fins aquest moment, ens consta que el personal afectat que no ha rebut resposta per part de la Diputaci\u00f3. Quan es rebi escrit amb una resoluci\u00f3 expressa (acte expr\u00e9s) de no fer efectiu els pagaments \u00e9s quan comen\u00e7a els terminis (veure punt 3).<\/span><\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><span style=\"font-family: 'arial black', sans-serif;color: #ff0000;font-size: 14pt\"><strong>REALITZAR RECURS ADMINISTRATIU<\/strong><\/span><\/li>\n<\/ol>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">El seg\u00fcent pas \u00e9s realitzar un recurs administratiu (d\u2019al\u00e7ada o reposici\u00f3). En aquest cas, \u00e9s molt important tenir en compte els terminis.<\/span><\/p>\n<p><span style=\"color: #000000\"><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif\">Terminis per a la interposici\u00f3 del recurs administratiu des de que presentem la petici\u00f3 de resoluci\u00f3 expressa:<\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><span style=\"font-family: 'arial black', sans-serif;color: #ff0000\"><strong><u>Acte expr\u00e9s:<\/u><\/strong><\/span> des de rebem resposta o resoluci\u00f3 de la Diputaci\u00f3, <strong><u>TENIM 1 MES PER A RECORRE.<\/u><\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Si transcorregut aquest termini <strong>no s\u2019ha interposat<\/strong> el recurs, la <strong>resoluci\u00f3 es ferma<\/strong> a tots els efectes.<\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><span style=\"font-family: 'arial black', sans-serif;color: #ff0000\"><strong><u>Acte presumpte:<\/u><\/strong><\/span> qualsevol moment a partir de l\u2019endem\u00e0 del dia en qu\u00e8, es produeixin els efectes del <u>silenci<\/u> administratiu (norma general: <strong>3 MESOS DES DE QUE VAM PRESENTAR LA PETICI\u00d3 DE RESOLUCI\u00d3 EXPRESSA<\/strong>).<\/span><\/li>\n<\/ul>\n<ol start=\"4\">\n<li><span style=\"font-family: 'arial black', sans-serif;font-size: 14pt;color: #ff0000\"><strong>REALITZAR RECURS <u>CONTENCI\u00d3S <\/u>ADMINISTRATIU<\/strong><\/span><\/li>\n<\/ol>\n<p><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"color: #000000\">Terminis d\u2019interposici\u00f3 del <strong>recurs contenci\u00f3s administratiu<\/strong>: Acte expr\u00e9s: 2 mesos<\/span><\/p>\n<p><span style=\"color: #000000\">Silencio administratiu : 6 mesos (a partir del dia que vam presentar el recurs administratiu)<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\"><strong>\u00a0<\/strong><\/span><\/p>\n<p><span style=\"color: #000000\"><span style=\"font-family: arial, helvetica, sans-serif\"><strong>\u00a0<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif\">En principi, es presenta recurs administratiu i posteriorment dintre dels terminis establerts, el recurs <em>Contenci\u00f3s Administratiu<\/em>. Encara que \u00e9s pot passar directament al <em>Contenci\u00f3s<\/em> sense realitzar pr\u00e8viament el recurs administratiu.<\/span><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">\u00c9s important que us assessoreu adequadament i en tot moment respecte a cada pas que heu de seguir.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif;color: #000000\">Tamb\u00e9 que no esgoteu els terminis per a presentar les demandes sobretot si necessiteu que us donin suport jur\u00eddic des del sindicat.
