{"id":2562,"date":"2015-05-10T22:33:41","date_gmt":"2015-05-10T21:33:41","guid":{"rendered":"http:\/\/coty.ccoo.cat\/?p=2562"},"modified":"2022-02-02T18:38:42","modified_gmt":"2022-02-02T17:38:42","slug":"protocolo-embarazo","status":"publish","type":"post","link":"https:\/\/ccoo.app\/coty\/protocolo-embarazo\/","title":{"rendered":"Mujeres embarazadas o en periodo de lactancia natural"},"content":{"rendered":"<h3 style=\"text-align: center\"><a href=\"http:\/\/coty.ccoo.cat\/wp-content\/uploads\/sites\/104\/2015\/05\/embarazo-ccoo.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-2575 size-thumbnail\" src=\"http:\/\/coty.ccoo.cat\/wp-content\/uploads\/sites\/104\/2015\/05\/embarazo-ccoo-150x150.jpg\" alt=\"embarazo-ccoo\" width=\"150\" height=\"150\" \/><\/a><\/h3>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><strong>Con el fin de proteger a las mujeres embarazadas y\/o en proceso de <\/strong><strong>lactancia, se desarrolla un procedimiento, <\/strong><strong><u>G.PR.PR<\/u><\/strong><strong>.016, para:<\/strong><\/span><\/span><\/p>\n<ul style=\"list-style-type: square;margin-left: 40px\">\n<li><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><strong>Establecer las v\u00edas de comunicaci\u00f3n como personal sensible<\/strong><\/span><\/span><\/li>\n<li><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><strong>Establecer las medidas correctoras oportunas en el puesto de <\/strong><strong>trabajo para que no existan riesgos durante el embarazo y\/o la lactancia<\/strong><\/span><\/span><\/li>\n<li><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><strong>Establecer unas v\u00edas de informaci\u00f3n a las trabajadoras sobre <\/strong><strong>cuales son los riesgos que su puesto o su tarea pueden ser <\/strong><strong>perjudiciales durante el embarazo y\/o la lactancia.<\/strong><\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"background-color: #ffd700\">A pesar de que el art\u00edculo 29.2.6 de la Ley de Prevenci\u00f3n de Riesgos Laborales (LPRL en adelante) establece, con car\u00e1cter general, la obligaci\u00f3n delos trabajadores y las trabajadoras de cooperar con la empresa para que puede \u00e9sta garantizarles unas condiciones de trabajo que sean seguras y no entra\u00f1en riesgos para su seguridad y salud, nos encontramos ante una situaci\u00f3n en la que la trabajadora no tiene obligaci\u00f3n de comunicar su estado.<\/span><\/span><\/span><\/li>\n<li><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"background-color: #ffd700\">En caso de no comunicaci\u00f3n no ser\u00eda imputable a la empresa el no haber tomado las medidas oportunas.<\/span><\/span><\/span><\/li>\n<li><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"background-color: #ffd700\">Para evitar las consecuencias que puede conllevar la falta de comunicaci\u00f3n, se incrementa la obligaci\u00f3n empresarial de informaci\u00f3n detallada sobre los posibles riesgos a la trabajadora si esta est\u00e1 embarazada. Con ese objeto, se edita \u00abcuadro informativo de actividades, tareas y productos qu\u00edmicos que pueden conllevar riesgo para el embarazo.\u00bb<\/span><\/span><\/span><\/li>\n<\/ul>\n<p style=\"margin-left: 3.6pt\"><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">La informaci\u00f3n detallada en los cuadros anexos, junto a lo indicado por Vigilancia de la Salud y el \u00c1rea de HSE servir\u00e1 como gu\u00eda para que los responsables de \u00e1rea y supervisores puedan asignar tareas a las operarias. Si no existe ninguna tarea asignable sin riesgo, el responsable del \u00e1rea y\/o supervisor, solicitar\u00e1 el cambio de puesto de trabajo a RRHH.<\/span><\/span><\/p>\n<p style=\"margin-left: 3.6pt\"><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">En caso de no existir ning\u00fan puesto en toda la empresa sin riesgo para el embarazo, RRHH determinar\u00e1 la suspensi\u00f3n temporal del contrato con reserva del puesto de trabajo, y facilitar\u00e1 la tramitaci\u00f3n del consiguiente subsidio que se determina en la ley Org\u00e1nica 3\/2007 y\/o RD 295\/2009.<\/span><\/span><\/p>\n<p style=\"margin-left: 3.6pt\"><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">En base a lo anterior, se establece que:<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><strong>EMBARAZADAS: <\/strong>Se recomienda que, cuando una trabajadora tenga conocimiento de que est\u00e1 en estado, lo comunique lo antes posible a su responsable, al \u00c1rea HSE o Servicio M\u00e9dico\/Vigilancia de la Salud, para estudiar\u00a0la necesidad o no de establecer medidas correctoras. Del mismo modo, se realizar\u00e1 un seguimiento de la gestaci\u00f3n y la necesidad o no de nuevas medidas correctoras. Todos los casos ser\u00e1n registrados por VS. De igual modo, una vez VS tenga conocimiento de esta situaci\u00f3n, informar\u00e1 a la mujer embarazada sobre los riesgos y las actividades que no puede realizar (tabla anexa). Tambi\u00e9n se informar\u00e1 al responsable del \u00e1rea para que pueda ejecutar el procedimiento.<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">En cualquier caso, una vez el responsable del \u00e1rea est\u00e9 informado y sin que les sea requerido directamente por ninguna otra v\u00eda, ha de tomar las medidas oportunas para limitar el riesgo de la mujer embarazada. Para ello adem\u00e1s de un listado de puestos de trabajo y\/o tareas que son compatibles con el embarazo y\/o la lactancia. Adem\u00e1s, editar\u00e1 un listado de los productos qu\u00edmicos presentes en el \u00e1rea con riesgo para el embarazo.<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">A modo gen\u00e9rico, y sin que existan situaciones concurrentes que requieran de un tratamiento especial, se establecer\u00e1n las limitaciones de tareas, actividades y usos de productos qu\u00edmicos indicados que sean incompatibles con el embarazo y\/o la lactancia.<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">Cuando exista duda sobre un riesgo, se aplicar\u00e1 el principio de precauci\u00f3n hasta que se determine si existe riesgo o no.<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><strong>LACTANCIA NATURAL: <\/strong>Se recomienda que, toda trabajadora que se reincorpore tras el permiso maternal y que practique la lactancia materna natural, lo comunique a HSE o al Servicio M\u00e9dico\/Vigilancia de la Salud, para estudiar la necesidad o no de establecer medidas correctoras.<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">En caso de la no comunicaci\u00f3n de un embarazo por parte de la trabajadora, lo descrito se aplicar\u00e1 cuando existan evidencias f\u00edsicas del embarazo.<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\">A modo de resumen, podemos decir que para cualquiera de los casos de sensibilidad, siempre prevalecer\u00e1 el criterio m\u00e9dico del servicio de vigilancia de la salud.<\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"background-color: #ffff00\">Dada la gran variabilidad de productos qu\u00edmicos en Coty en espacios cortos de tiempo, no se edita ning\u00fan listado general sobre los productos qu\u00edmicos que contienen estas frases de riesgo. Los listados los han de editar las \u00e1reas afectadas en el momento en que les sea comunicada la presencia de un trabajador\/a sensible.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"background-color: #ffff00\">Para la obtenci\u00f3n de un listado actualizado de productos qu\u00edmicos con estas frases de riesgo, se debe utilizar el programa Chemges seg\u00fan el procedimiento G.R&amp;D.IT.9. La primera informaci\u00f3n siempre ser\u00e1 la Ficha de seguridad y la etiqueta del producto qu\u00edmico.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: 16px\"><span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"background-color: #ffff00\">Una vez conocidos los productos a los que est\u00e1 expuesta la embarazada, se ha de valorar la exposici\u00f3n en funci\u00f3n continuaci\u00f3n se describen los principales riesgos a controlar\u00a0durante el periodo de gestaci\u00f3n y lactancia natural.<\/span><\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"font-size: 16px\">Los puestos de trabajo pueden sufrir modificaciones en la exposici\u00f3n\u00a0a diferentes riesgos. El encargado,\u00a0supervisor o responsable del \u00e1rea ser\u00e1 el que vele porque solo se realicen los trabajos con riesgo\u00a0ser\u00e1 el que vele porque solo se realicen los trabajos con riesgo\u00a0tolerable y de mantener informada a la trabajadora de las tareas que\u00a0puede o no realizar.<\/span><\/span><br \/>\n<span style=\"font-family: arial,helvetica,sans-serif\"><span style=\"font-size: 16px\">En caso de duda se puede consultar con el servicio de Violencia de\u00a0la Salud.<\/span><\/span><br \/>\n<span style=\"font-family: arial,helvetica,sans-serif\"><span
