{"id":2837,"date":"2019-04-11T12:03:00","date_gmt":"2019-04-11T10:03:00","guid":{"rendered":"https:\/\/ccoo.app\/7itria\/que-es-el-dret-a-la-desconnexio-digital\/"},"modified":"2023-07-20T10:44:42","modified_gmt":"2023-07-20T08:44:42","slug":"que-es-el-dret-a-la-desconnexio-digital","status":"publish","type":"post","link":"https:\/\/ccoo.app\/7itria\/que-es-el-dret-a-la-desconnexio-digital\/","title":{"rendered":"Qu\u00e8 \u00e9s el Dret a la Desconnexi\u00f3 Digital?"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;      &lt;![endif]--><!--[if gte mso 9]&gt;   Normal  0      21      false  false  false    CA  X-NONE  X-NONE                                                                          &lt;![endif]--><!--[if gte mso 9]&gt;                                                                                                                                                                                                                                                                                    &lt;![endif]--><!--[if gte mso 10]&gt;&lt;![endif]--> <\/p>\n<div style=\"text-align: justify\">\n<div style=\"clear: both;text-align: center\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\"><a href=\"https:\/\/1.bp.blogspot.com\/-_wpepp9TmTM\/XK8RjFq9iuI\/AAAAAAAAA50\/djI9P6m9Bc8Zpg62vp2PGVauL4NBsAtTwCLcBGAs\/s1600\/LOGO%2BCCOO%2B7%2BI%2BTRIA.png\" style=\"margin-left: 1em;margin-right: 1em\"><img loading=\"lazy\" decoding=\"async\" border=\"0\" data-original-height=\"156\" data-original-width=\"547\" height=\"91\" src=\"https:\/\/1.bp.blogspot.com\/-_wpepp9TmTM\/XK8RjFq9iuI\/AAAAAAAAA50\/djI9P6m9Bc8Zpg62vp2PGVauL4NBsAtTwCLcBGAs\/s320\/LOGO%2BCCOO%2B7%2BI%2BTRIA.png\" width=\"320\" \/><\/a><\/span><\/span><\/span><\/div>\n<p><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">El <i>Dret a la Desconnexi\u00f3 Digital<\/i> fora de l&#8217;horari de treball es conceptua com la limitaci\u00f3 a l&#8217;\u00fas de les tecnologies de la comunicaci\u00f3 (missatgeries, wsaps i correus electr\u00f2nics en la seva major mesura), per a garantir el temps de descans i vacances dels treballadors\/es.<\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">Tanmateix, al respecte d\u2019aquesta q\u00fcesti\u00f3 hi ha establerta una directiva europea, que en l\u2019article 88.1 diu el seg\u00fcent:<\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><br \/><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><i><span style=\"line-height: 115%\">\u201cEls\/les treballadors\/es&#8230;tindran Dret a la Desconnexi\u00f3 Digital a fi de garantir, fora del temps de treball legal o convencionalment establert, el respecte del seu temps de descans, permisos i vacances, aix\u00ed com de la seva intimitat personal i familiar\u201d<\/span><\/i><span style=\"line-height: 115%\">.<\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><br \/><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">Aquest \u00e9s potser el dret que m\u00e9s ha donat a parlar pel que fa refer\u00e8ncia als drets digitals. <\/span><\/span><\/span><\/div>\n<div style=\"clear: both;text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><a href=\"https:\/\/4.bp.blogspot.com\/-7Z7DPrl09TI\/XK8QeUcVwzI\/AAAAAAAAA5o\/L0uz4eBbG1o0vC9372EKmvWNHN7B-2C4gCLcBGAs\/s1600\/2.-Business-Accounting-1030x687.jpg\" style=\"clear: left;float: left;margin-bottom: 1em;margin-right: 1em\"><img loading=\"lazy\" decoding=\"async\" border=\"0\" data-original-height=\"636\" data-original-width=\"960\" height=\"132\" src=\"https:\/\/4.bp.blogspot.com\/-7Z7DPrl09TI\/XK8QeUcVwzI\/AAAAAAAAA5o\/L0uz4eBbG1o0vC9372EKmvWNHN7B-2C4gCLcBGAs\/s200\/2.-Business-Accounting-1030x687.jpg\" width=\"200\" \/><\/a><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\">T\u00e9 a veure amb la conciliaci\u00f3 entre la vida laboral i la personal o familiar. Per tant, es podria considerar una expressi\u00f3, en l&#8217;\u00e0mbit laboral, dels drets fonamentals a la intimitat i a la integritat f\u00edsica i ps\u00edquica.<\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><br \/><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">B\u00e0sicament, es podria definir com la limitaci\u00f3 a l&#8217;\u00fas de les tecnologies per a garantir el temps de descans, permisos i vacances dels treballadors\/es i la intimitat personal i familiar. Per la qual cosa, a tall d&#8217;exemple, <b>fora de l&#8217;horari laboral els\/les treballadors\/es no estarien obligats\/des a respondre trucades, sms, missatges de text o correu electr\u00f2nics del treball.<\/b><\/span><\/span><\/span><\/div>\n<p><a name='more'><\/a><\/p>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><br \/><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">L&#8217;empresari no pot de cap manera pressuposar, sense violentar la normativa nacional i comunit\u00e0ria, que els seus treballadors\/es han d&#8217;estar sempre disponibles i alerta per a respondre als seus missatges relacionats amb problemes laborals. Per la qual cosa, si es col\u00b7loquen en una situaci\u00f3 \u201cd\u2019il\u00b7localitzables\u201d i no responen al seu tel\u00e8fon m\u00f2bil o als correus en els seus ordinadors fora de l&#8217;horari laboral, no es poden qualificar tals conductes com a incompliments laborals sense que, per tant, se les hagi de sancionar disciplin\u00e0riament.<\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><br \/><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">Per una altra banda cal tenir present que, la Directiva 2003\/88\/CE -EDL 2003\/198134-, que s&#8217;aplica a tots els sectors d&#8217;activitat, privats i p\u00fablics, excepte les excepcions que en ella es preveuen (art.1.3), defineix el concepte de temps de treball com: <i>\u201ctot per\u00edode durant el qual el\/la treballador\/a romangui en el treball, a disposici\u00f3 de l&#8217;empresari i en l&#8217;exercici de la seva activitat o les seves funcions\u201d<\/i> (art.2.1).<\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><br \/><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">Dit aix\u00f2, res impedeix que <b>el denominat temps de contacte o disposici\u00f3 tecnol\u00f2gica per a atendre informaci\u00f3 provinent de l&#8217;empresa, i \u00e0dhuc realitzat fora del lloc o centre de treball, sigui considerat com a temps de treball, i per tant retribu\u00eft o compensat per temps de descans i computat a l&#8217;efecte de determinar la durada m\u00e0xima de la jornada laboral di\u00e0ria i setmanal<\/b>. Doncs, el fet que el\/la treballador\/a es trobi a casa seva i fora de la jornada laboral no \u00e9s obstacle per a atribuir tal naturalesa laboral a un temps extra dedicat a fer gestions en inter\u00e8s per a la seva empresa, a trav\u00e9s dels sistemes de comunicaci\u00f3 interactius.<\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><br \/><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">D&#8217;altra banda, el concepte <i>temps de descans<\/i> es defineix en sentit negatiu, per exclusi\u00f3 de l&#8217;altre, com: <i>\u201ctot per\u00edode que no sigui temps de treball\u201d<\/i>, (art.2.2 -EDL 2003\/198134-), per la qual cosa el\/la treballador\/a o est\u00e0 en temps de treball o de descans. <b>El temps de descans ha de ser-ho en sentit ple, sense que es contempli un tercer temps, intermedi entre els de treball i descans.<\/b><\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\"><b>&nbsp;<\/b> <\/span><\/span><\/span><\/div>\n<div style=\"text-align: justify\"><span style=\"font-size: small\"><span style=\", sans-serif\"><span style=\"line-height: 115%\">Com es dedueix de la STJUE 9-9-03, C-151\/2002, Assumpte Jaeger -EDJ 2003\/64017-, un per\u00edode de descans es caracteritza perqu\u00e8 durant la seva durada <i>\u201cel\/la treballador\/a no est\u00e0 subjecte a cap obligaci\u00f3 vis a vis amb el seu empresari, la qual cosa podria impedir-li el dedicar-se lliurement i sense interrupci\u00f3 a la consecuci\u00f3 dels seus propis interessos\u201d<\/i> (par\u00e0graf 94).<\/span><\/span><\/span><\/div>\n","protected":false},"excerpt":{"rendered":"<p>El Dret a la Desconnexi\u00f3 Digital fora de l&#8217;horari de treball es conceptua com la limitaci\u00f3 a l&#8217;\u00fas de les tecnologies de la comunicaci\u00f3 (missatgeries, wsaps i correus electr\u00f2nics en &#8230; <a title=\"Qu\u00e8 \u00e9s el Dret a la Desconnexi\u00f3 Digital?\" class=\"read-more\" href=\"https:\/\/ccoo.app\/7itria\/que-es-el-dret-a-la-desconnexio-digital\/\" aria-label=\"M\u00e9s informaci\u00f3 sobre Qu\u00e8 \u00e9s el Dret a la Desconnexi\u00f3 Digital?\">Read more<\/a><\/p>\n","protected":false},"author":3351,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[544,411,583],"tags":[549],"class_list":["post-2837","post","type-post","status-publish","format-standard","hentry","category-2019-2020","category-ccoo-catalunya","category-noticies-salut-i-seguretat-laboral","tag-dret-desconnexio-digital","generate-columns","tablet-grid-50","mobile-grid-100","grid-parent","grid-33"],"_links":{"self":[{"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/posts\/2837","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/users\/3351"}],"replies":[{"embeddable":true,"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/comments?post=2837"}],"version-history":[{"count":1,"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/posts\/2837\/revisions"}],"predecessor-version":[{"id":3838,"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/posts\/2837\/revisions\/3838"}],"wp:attachment":[{"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/media?parent=2837"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/categories?post=2837"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/ccoo.app\/7itria\/wp-json\/wp\/v2\/tags?post=2837"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
